By way of the present petition filed under section 483 of the
Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim
bail in case FIR No.474/2020 dated 04.11.2020 registered under
section 302 of the Indian Penal Code, 1860 (‘IPC‘) at P.S.: Kalandi
Kunj, South East Delhi, to attend the wedding ceremonies of his sister,
which ceremonies are stated to have been scheduled between
17.03.2026 and 30.03.2026.
2. Notice on this petition was issued yesterday i.e., 27.03.2026.
3. Ms. Shubhi Gupta, learned APP for the State has handed-up a copy of
Status Report under cover of Index dated 28.03.2026. The same is
taken on record.
4. Mr. Vikas Singh, learned counsel for the petitioner submits, that the
petitioner’s sister Ruksar is scheduled to get married on 30.03.2026 at a
certain venue in Madanpur Khadar Extension, New Delhi.

5. Counsel submits, that being the brother, the petitioner’s presence is
necessary to fulfil his role and obligations towards his sister.
6. Ms. Gupta opposes the grant of interim bail, submitting, that the case
concerns allegations of the brutal killing of a 13-year-old boy; and
there are several eye witnesses who have testified against the petitioner
as to his role in the offence.
7. The status report records that the Investigating Officer has verified that
the wedding of the petitioner’s sister is scheduled to take place on
30.03.2026 at the aforesaid venue.
8. Though the nominal roll is not available, the petitioner is stated to have
been arrested in the present case on 05.11.2020; and has been in
judicial custody ever since as an undertrial.
9. The petitioner’s SCRB record dated 28.03.2026, a copy of which has
been appended to the status report, shows that the petitioner has one
other criminal involvement viz., case FIR No.479/2020 registered under
sections 394/34 of the IPC at P.S.: Kalindi Kunj, South-East Delhi.
Counsel for the petitioner however states, that the petitioner has been
acquitted in that case.
10. Upon a conspectus of the foregoing, and keeping in mind only the
interests of the petitioner’s sister, whose wedding ceremonies may
come under cloud if her brother, viz., the petitioner, is not present at the
ceremonies, this court is persuaded to grant to the petitioner – Shahdab
@ Pulsar s/o Said Ahmed Qureshi – limited interim bail for 03 days
commencing 29.03.2026 to 31.03.2026, subject to the following
conditions:

10.1. The petitioner shall furnish a personal bond in the sum of
Rs.25,000/- (Rs. Twenty-five Thousand Only) with 02 sureties in
the like amount from family members, to the satisfaction of the
Jail Superintendent;
10.2. The petitioner shall not leave the State of Delhi without
permission of the court and shall ordinarily reside at the address
as per prison records/as mentioned in the application;
10.3. The petitioner shall furnish to the Investigating Officer/S.H.O
P.S.: Kalandi Kunj, South-East Delhi a cell-phone number on
which the petitioner may be contacted at any time and shall
ensure that the number is kept active and switched-on at all
times;
10.4. If the petitioner has a passport, he shall surrender the same to the
learned trial court and shall not travel out of the country;
10.5. The petitioner shall not contact, nor visit, nor offer any
inducement, threat, or promise to any of the prosecution
witnesses or other persons acquainted with the facts of case. The
petitioner shall not tamper with evidence nor otherwise indulge
in any act or omission that is unlawful or that would prejudice
the proceedings in the pending trial; and
10.6. Upon expiry of the period of interim bail, the petitioner shall
surrender before the Jail Superintendent.
11. A copy of this order be sent to the concerned Jail Superintendent
forthwith.
12. The petition stands disposed-of in the above terms.
