1. In this writ petition, the Petitioners seek a direction from this Court to
quash the orders rejecting their application for regularisation and
directing demolition of the alleged unauthorised constructions, and to
command the competent authorities to regularise the rooftop
penthouses raised over Jayadev Tower.

I. FACTUAL MATRIX OF THE CASE:
2. Succinctly put, the facts of the case are as follows:
(i) The Petitioners are the recorded owners of land comprising Plot Nos.
208/3522, 123/3404, 3521, 2086/3405 and 123/3406 situated at Mouza
Jayadev Vihar, Bhubaneswar. Pursuant to an agreement dated
25.09.1995 with M/s Maitree Developers Private Limited, a multi-
storeyed residential complex known as “Jayadev Tower” was
constructed over the land after obtaining approval of the building plan
from the Bhubaneswar Development Authority. The complex consists
of two blocks, namely Block-A, stated to have been retained for the
landowners, and Block-B, comprising approximately forty residential
units transferred to individual flat owners who subsequently formed
the Jayadev Tower Apartment Owners’ Association.
