UPON hearing the counsel the Court made
the following
O R D E R
1. The petitioner has been denied
anticipatory bail by the High Court in
connection with First Information Report
No.593/2023 registered with Dabua Police
Station, District Faridabad for the offence
punishable under Sections 323, 506, 148, 149,
325, 307, 379B, respectively of the Indian
Penal Code (for short, “the IPC”).
2. We take notice of the fact that the
First Information Report came to be lodged by
the mother of the injured witness.
3. It is the case of the prosecution that
on account of the injuries suffered at the
time of assault, the injured became
unconscious and he regained consciousness in
the hospital after a period of three days.
4. In the FIR lodged by the mother of the
injured, the name of the present petitioner

does not figure.
5. Besides, initially, the FIR was lodged
only for the offence punishable under
Sections 323, 506, 148 and 149 of the IPC.
Later in point of time, Sections 325, 307 and
379B, respectively came to be added.
6. In connection with the aforesaid
offence, five persons came to be arrested.
7. We heard Mr. Dhruv Gautam, the learned
counsel appearing for the petitioner and Mr.
Hemant Gupta, the learned counsel appearing
for the State.
8. We are informed that all five have been
released on bail. We are further informed
that the injured is also now out of danger
and came to be discharged from the hospital
long-time back.
9. In the overall view of the matter, we
are convinced that the petitioner has made
out a case for grant of anticipatory bail.

10. We order that in the event of arrest of
the petitioner in connection with the FIR
referred to above, he shall be released on
bail by the Investigating Officer, subject to
terms and conditions that he may deem fit to
impose.
11. Once the petitioner is released on
anticipatory bail by the I.O. he shall
thereafter appear before the concerned Trial
Court and furnish fresh bail bonds.
12. We also direct the petitioner to appear
before the I.O. for the purpose of joining
investigation and also for his interrogation.
13. With the aforesaid, the Special Leave
Petition stands disposed of.
14. Pending application(s), if any, also
stand disposed of.
