UPON hearing the counsel the Court made the following
O R D E R
1. The petitioner who had been denied regular bail by the High
Court, has been in judicial custody since 15.02.2025, in
connection with FIR No. 727/2025 filed at PS Surajpur,
District Gautam Buddha Nagar Commissionerate, Uttar Pradesh
for the offence punishable under Sections 3 and 4 of the
Protection of Children from Sexual Offences Act, 2012 (for
short “POCSO”), Sections 354-C, 376, 384, 504 of the Indian
Penal Code, 1860 (for short “the IPC”) and Section 67 of
the Information Technology Act, 2000 (for short “the IT
Act”).
2. Learned Counsel for the petitioner submits that, in fact
the petitioner and the alleged victim were in a consensual
relationship, and even the parents of the petitioner knew
about this relationship. The objection of the parents was
merely with respect to the petitioner being unemployed. The

allegations raised are false and unsubstantiated.
3. The learned Government Advocate on the other hand, points
out that the victim was a minor and there was allegation of
rape and circulation of compromising photographs. On
investigation it was also found that, the petitioner was
operating and maintaining Instagram accounts in which the
photos were uploaded.
4. The Investigating Officer was also present in court, with
whom we interacted. We specifically put a query to him as
to the nature of the photos, alleged to have been
circulated. We showed him the photographs produced by the
petitioner in a sealed cover, which he affirms were the
photographs circulated. The photographs only show both the
petitioner and the alleged victim together.
5. We find that the allegation itself is that the victim got
acquainted with the petitioner in the year 2019, and the
FIR is of the year 2025. Admittedly, now the victim is a
major. The chargesheet has been filed in May 2026, and
there is no progress in the trial.
6. On a prima facie consideration of the material on record,
we are of the opinion that the petitioner can be released

on bail, subject to such terms and conditions that the
Sessions Judge, Gautam Buddha Nagar (the jurisdictional
court) may deem fit to impose. Ordered accordingly. One of
the conditions shall be that, the petitioner shall not
enter Noida or Delhi, unless his presence is required in
the Court, for continuation of the trial. The petitioner
shall cooperate with the trial, and shall remain present
before the Trial Court, as and when directed.
7. With the above directions, the Special Leave Petition is
disposed of.
8. Pending application(s), if any, shall also stand disposed
of.
