This case is taken up today for settlement before the Special Lok
Adalat. Both the parties are present. Mr.N.Baskaran, learned counsel for
the appellant and Mr.B.Jawahar, learned Counsel for the respondent are
present. After mutual discussion and negotiation between both parties,
they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT
Both sides are present before the Special Lok Adalat. After
negotiation, the parties voluntarily agreed for the following settlement:
1.In full and final settlement towards all amount due, towards the
subject matter Cheque in Crl.A.No.833 of 2023, pending before this Court
and the Appeal Suit pending in A.S.No.5 of 2026 on the file of the District
& Sessions Court, Tiruvannamalai, filed as against O.S.No.78 of 2020 on
the file of the Additional Subordinate Court, Tiruvannamalai, the
respondent in the Criminal Appeal namely R.B.Sudhakar, has agreed to
pay a total sum of Rs.7,00,000/- (Rupees Seven Lakhs Only) and the
appellant namely S.Ramesh has agreed to accept the same.
2.The said sum shall be paid within a period of Ninety days from
today i.e., on or before 19.10.2026.
3.The respondent will also be entitled to pay the sum in a staggered
manner, by way of Demand Draft/Cheque/Cash before the District &
Sessions Court, Tiruvannamalai in A.S.No.5 of 2026, or transfer to the
Bank account of the appellant by way of banking transaction and the proof
of the same shall be filed before the Appellate Court in the Appeal Suit.
4.By the said payment, the claim made in O.S.No.78 of 2020 on the
file of the Additional Subordinate Court, Tiruvannamalai shall stand
satisfied and also the claim made in the Criminal Appeal shall also be
satisfied.

5.A copy of this Special Lok Adalat award shall also be produced
before the Appellate Court and the Appellate Court shall adjourn the
matter after ninety days and if the payment is done, the same shall be
recorded in the Appellate Court as well as in the Criminal Appeal and the
proceedings will be closed.
6.If the amount is not paid as aforesaid, the parties will be entitled
to continue both the cases.
7.Call this Criminal Appeal on or after 20.10.2026, for recording the
disposal of the same on the basis of the settlement in this award.
8.The Appellate Court namely District & Sessions Court,
Tiruvannamalai will also, on the date of recording the final settlement, be
entitled to pass orders relating to refund of full Court fee to the appellant
in this Criminal Appeal.
