1. Through the medium of connected contempt petition, the petitioner
is seeking compliance of the judgment dated 12.02.2015 passed by the writ
court in SWP No. 2542/2012, whereby the respondents were directed to
implement the earlier court judgment and pass requisite orders in the light of
the observations made in the said judgment. It was directed that respondents
shall initiate and conclude the process within two weeks. It seems that when
the judgment of the writ court was not implemented by the respondents,
Rule was framed against the contemnors and they were directed to show
cause as to why they should not be punished for having committed contempt
of the court.
2. At this stage, the respondents/contemnors, seem to have approached
the Supreme Court by way of an SLP, which was registered as Civil Appeal
Nos. 7395-7397 of 2021 titled “The State of Jammu and Kashmir and Others
vs. Shahnaza Parveen and Others“. It came to be disposed of by the
Supreme Court in terms of order dated 12.09.2024, by providing that
contempt proceedings would await the final outcome of the case titled
“Union Territory of Jammu and Kashmir and Others versus Saba Wani“
(SLP Civil No. 12210 of 2023). The final judgment in Saba Wani supra has
been delivered by the Supreme Court on 30th April, 2026, by directing inter
alia that formal engagement orders to the candidates of the select panel shall
be issued within a period of eight weeks. The said period of eight weeks has
already elapsed, but the respondents/contemnors have not come up with the
compliance till date.
3. Learned counsel for the respondents seeks one opportunity to come
up with the compliance report.
4. In the interests of justice, the request is granted, and it is provided
that in case the compliance report is not filed by next date of hearing, the
present incumbents shall appear before this court in person through virtual or
physical mode and explain as to why they shall not be punished for having
committed contempt of the court.
5. List on 11th August, 2026.
6. A copy of this order be sent to respondents through counsel.
