    1. Heard learned counsel for the parties.

    2. Transfer Petition(Civil) No. 2570/2025 has

    been filed by the wife seeking transfer of a

    divorce case instituted by the husband bearing

    H.M.O.P. No. 4532 of 2024, titled as “P. Mohan Raaj

    Vs. Resham Kaur” pending before the Family Court at

    Chennai to the Principal Family Judge, Lucknow,

    Uttar Pradesh whereas the Tansfer

    Petition(Criminal) No.50/2026 has been filed by the

    husband seeking transfer of a case instituted by

    the wife bearing Criminal Misc. Case No. 7445 of

    2024, titled as “Resham Kaur Vs. Mohanraj” pending

    before the Court of Special Chief Judicial

    3. During the pendency of the present

    petitions, with the consent of the parties, the

    matters were referred to the Supreme Court

    Mediation Centre for an amicable settlement.

    4. The parties have entered into a settlement

    and the Settlement Agreement dated 25.03.2026 is on

    record.

    5. The wife, in-person, is present in Court and

    the husband appeared through virtual mode. They

    have agreed that they have entered into the

    settlement. The parties submit that the petitions

    may be disposed of in terms of the said settlement.

    6. In terms of the aforesaid settlement, a

    joint application bearing I.A. No. 118031 of 2026

    seeking dissolution of marriage between the parties

    by a decree of divorce on the basis of mutual

    consent has been filed under Article 142 of the

    Constitution of India.

    7. Under the settlement, the parties have inter

    alia agreed to dissolve their marriage by a decree

    of divorce subject to the husband paying a sum of

    Rs.16,00,000/-(Rupees sixteen lakhs only) to the

    wife in full and final settlement of all the claims

    towards alimony, stridhan, gifts etc. The Demand

    Draft of the said amount of Rs.16,00,000/-(Rupees

    sixteen lakhs only) bearing No.024545 dated

    27.03.2026 drawn on IDBI Bank in favour of the wife

    ‘Resham Kaur’ has been handed over in Court today

    to the wife by the learned counsel appearing for

    the husband.

    8. It has also been agreed that all civil and

    criminal cases pending between the parties as

    mentioned in Para ‘3’ of the settlement agreement

    shall stand closed and none of the parties would

    pursue them any further. The cases referred to are

    as follows:

    “(i) Petitioner/wife has filed Criminal
    Misc. Case No. 36671 of 2025 titled as
    State of U.P. Vs. PonnuRaj and others
    arising out of F.I.R No. 12 of 2025 U/s.
    498-A, 323, 504, 506, 354 of I.P.C., 1860
    at PS Indra Nagar District Lucknow, Uttar
    Pradesh pending before Ld. ACJM Court No.26
    Lucknow Uttar Pradesh;

    (ii) Petitioner/wife has filed Criminal
    Misc. Case No. 7445 of 2024 titled as
    Resham kaur Vs. Mohan Raj PonnuRaj and
    others Under Section 12 The Protection of
    Women from Domestic Violence Act, 2005
    pending before Ld. ACJM Court No.26 Lucknow
    Uttar Pradesh;

    (iii) Petitioner/wife has filed Criminal
    Misc. Case No. 3073 of 2024 titled as
    Resham Kaur Vs. P. Mohan Raj, pending
    before Ld. Additional Principal Judge Court
    No. 3 Lucknow Uttar Pradesh;

    (iv) Respondent/husband has filed H.M.O.P.
    No. 4532/2024, titled as P. Mohan Raaj Vs.
    Resham Kaur, pending before the Ld. Family

    Court at Chennai, Tamil Nadu; and

    (v) Respondent/husband has filed
    Application U/s. 528 BNSS No. 1053 of 2026,
    titled as Mohan Raaj @ P. Mohan Raaj and 3
    Others Vs. State of Uttar Pradesh and Anr.,
    pending before the Hon’ble High Court of
    Judicature at Allahabad, Bench at Lucknow.”

    9. Considering the fact that the marriage has

    been irretrievably broken down and the parties have

    agreed to live separately, we consider it proper to

    exercise our power under Article 142 of the

    Constitution of India and direct for drawing a

    decree of divorce by mutual consent in the Divorce

    Case bearing H.M.O.P. No. 4532 of 2024, titled as

    “P. Mohan Raaj Vs. Resham Kaur” pending before the

    Family Court at Chennai which shall stand closed

    accordingly.

    10. Similarly, all other cases referred to above

    shall also stand withdrawn and closed.

    11. The parties shall remain bound by the terms

    and conditions of the Settlement Agreement.

    12. The application being I.A. No.118031 of 2026

    is allowed in the above terms and the transfer

    petitions stand disposed of accordingly.

    13. The settlement agreement shall form part of

    this order.

    14. The Registry shall inform the respective

    Courts about this order where the proceedings are

    pending in the aforesaid cases.

    15. We place on record our appreciation for the

    sincere work done by the Supreme Court Mediation

    Centre in facilitating the parties to arrive at a

    settlement.

    16. The instant transfer petitions stand

    disposed of.

    17. Pending application(s), if any, shall stand

    disposed of.
