ORDER
Marital discord has separated the petitioner -wife
and the respondent-husband. The two children born in the
wedlock are with the respondent-husband; as noticed by
this Court in order dated 17.04.2026 with a total
disconnect from their mother, the petitioner.
2. There are various cases pending against each other
and attempts to mediation having failed, this Court
intervened and arrived at an amicable settlement i.e. final
separation on payment of Rs. 17 lakhs (Rupees
Seventeen Lakhs). The terms of the settlement have been
reduced to writing in the application filed under Article142

for the petitioner, in the presence of the petitioner,
confirms that the entire amount of alimony of Rs. 17 lakhs
have been received. The terms of the settlement indicate
all the following cases pending between each other would
be withdrawn.
3. As of now the petitioner has filed two cases and one
complaint which are as under:
I. Under Protection of Women from Domestic Violence
Act, 2005 with an application under Section 23 for
grant of interim and ex-parte orders registered as
MC No. 02/2025 titled ‘Smt. Rekha vs. Mahesh
Kumar & Anr.’ before the Chief Judicial
Magistrate, South-West District, Dwarka
District Court, New Delhi.
II. FIR No. 215 of 2025 filed by the petitioner against
the respondent husband, at Police Station
Najafgarh under Sections 98A, 406 and 34 of
the Indian Penal Code, 1860.
III. A complaint before the CAW Cell, Dwarka, Police
Station Dabri, New Delhi against the respondent and
his sister.

4. The two cases referred to above, and the complaint
shall stand withdrawn on production of this order before
the competent court/authority.
5. The respondent husband has also filed FIR No. 363 of
2024 against the petitioner at Police Station Mundawar
under Sections 137(2), 87 and 303(2) of the Bharatiya
Nyaya Sanhita, 2023. It has been agreed upon that the
petitioner wife would execute necessary documents and
cooperate with the police for release of certain articles,
which is the subject matter of this FIR. The Station House
Officer shall depute suitable police personnel to carry out
release of the articles and to ensure execution of the
documents, the inventory of which shall be supplied to
the respondent husband and kept in the files of the SHO
of the police station.
6. The children having lost contact with the mother, it
has been agreed that she would be permitted to have
video calls at regular intervals, at least twice a month and
meeting would be facilitated on mutually convenient
times at the place of residence of the children, at the

option of the children, who will remain in the custody of
the father, the respondent.
7. The above terms are recorded and finding the
marriage to have irretrievably broken down, we invoke
our powers under Article 142 of the Constitution of India
and grant a decree of divorce to the parties, dissolving
their marriage.
8. The H.M.A. Petition No. 240/109 of 2024 titled
‘Mahesh Kumar vs. Rekha Devi’ pending before the
Additional District Judge, Mundawar, Alwar District
Court, Rajasthan, shall hence be disposed of based on
the orders passed by us.
9. The above petition is disposed of in the aforestated
terms.
10. Pending application(s), if any, shall stand disposed
of.
