    1] They are heard and perused the case diary.

    2] This is the applicant’s first bail application filed under Section 483 of
    Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of Cr.P.C. as he is
    implicated in connection with Crime No.207/2019 registered at Police
    Station – Talen, District Rajgarh for offence punishable under Section 420,
    409, 120-B of IPC and under section 6(1) and 6(2) of M.P. Nikshepakon Ke
    Hiton Ka Sanrakshan Adhiniyam 2000 (hereinafter referred to as the

    3] Facts in brief are that Crime No.207/2019 was registered at Police Station
    Telan, district Rajgarh on the complaint of one Arvind Rajput R/o Village
    Nehli Police Station Talen that Garvit Innovative Promoters Limited (Bike
    Boat) and Amazing Committed Alliance Pvt. Ltd. (Go Bike cab) have
    committed cheating by alluring him for investment promising higher returns

    and after receiving an amount of Rs.5,67,600/- transferred through Net
    Banking and thereafter found that office of the companies were closed,
    hence, registered the offence on 08.07.2019 against Sanjay Bhati, Rajesh
    Bhardwaj, Karan Pal Singh, Dislbag Singh and present applicant.
    4] The present application has been preferred on the ground that the
    applicant is a retired Army Personnel and has been arrayed as an accused
    merely by virtue of his having been a Director for an extremely brief and
    peripheral period from 22.12.2018 to 01.02.2019 only for a duration of
    approximately 40 days. The applicant had no direct connection with the
    alleged fraudulent transactions disclosing four criminal antecedents i.e. (i)
    Crime No.448/2020 registered at Police Station Khudel Indore under
    Sections 406 and 420 of IPC; (ii) Crime No.5587/2021 registered at Police
    Station Dadri District Gautam Budh Nagar, U.P under Section 2/3(1) of U.P.
    Gangsters Act, 1986; (iii) Crime No.SCIR/LKZO/05/2019 by Enforcement
    Directorate Lucknow, under Section 3 and 4 of PMLA Act, 2002 and (iv)
    Crime No.209/2019 at Police Station Dadri, District Gautambudh Nagar,
    U.P. under Section 420, 409, 467, 468, 471, 201 and 120-B of IPC, Section
    58-B
    Sub Section 4(a) of RBI Act, 1934, Section 76-A of Companies Act,
    1956, Section 4, 5 and 6 of Price, Chits and Money Circulation Scheme
    (Banning) Act, 1978.

    6] Considering the nature of the allegations against the present applicant, the
    applicant’s previous criminal antecedents, and the fact that the applicant was

    registered, this Court is not inclined to grant bail. Therefore, the present bail
    application filed under Section 483 of the Bharatiya Nagarik Suraksha
    Sanhita, 2023, is dismissed at present .
