28. Case of the Plaintiff as set out in the plaint is that the Plaintiff, widely
known by his screen name “Ravi Kishan”, is one of the most popular and
acclaimed actor and producer in the Indian film industry and his
performances on big and small screens both, have left an indelible mark and
he enjoys enviable reputation and goodwill amongst the masses. Plaintiff
took to politics in the year 2014 and has excelled even that field and is
currently an MP from Gorakhpur Constituency (UP). Plaintiff has starred in
over 750 films spanning across genres, languages and audiences and include
films in Hindi, Telugu, Kannada and Tamil languages. Plaintiff’s journey in
the film industry is a tale of perseverance, findings its way to the heights of
success. Plaintiff got his first break in 1992 in Hindi Film Pitambar, co-
starring renowned Bollywood actors Mithun Chakraborty, Raza Murad and
Kiran Kumar, whereafter he was casted in many blockbuster films in
supporting roles. Plaintiff’s first major supporting role, which earned him
immense appreciation for his stellar performance, was in the film Tere Naam
(2003), starring superstar Salman Khan and Bhumika Chawla in the lead
roles.
29. It is stated that Plaintiff left a memorable impression in the minds of
his audience through his acting skills and talent in many films which include
the comedic portrayal of Chhote in Phir Hera Pheri (2006) and in 2008

Plaintiff starred in the comedy drama, Welcome to Sajjanpur, directed by
Shyam Benegal, one of the pioneers in Indian parallel cinema. Plaintiff has
to his credit number of diverse and unforgettable roles in films such as
Money Hai Toh Honey Hai (2008), Mere Dad ki Maruti (2013), Tanu Weds
Manu (2011) and Son of Sardaar-2 (2025). Plaintiff is widely known to
experiment with different characters and roles and has been and is a well
known and familiar face in the world of cinema for over three decades,
known much for being a versatile actor and illustratively, the versatility in
his acting skills is visible in films such as Raavan (2010), directed by
legendary film director Mani Ratnam, where Plaintiff played the gritty role
of the fierce naxalite and brother to Abhishek Bacchan’s lead. He was
specially noticed in his action-packed cameo in Agent Vinod (2012), where
he left a lasting impression as an undercover spy and had starred alongside
Saif Ali Khan and Kareena Kapoor. Plaintiff’s role as an antagonist in Bullet
Raja (2019) and as a daring police officer in Batla House (2019) has not
been forgotten. Plaintiff earned huge appreciation for his performance in the
Anurag Kashyap directed sports drama Mukkabaaz (2017) and recently his
performance in the Hindi film Laapata Ladies (2023), which was also
released internationally as Lost Ladies, has earned him unprecedented praise
and several awards including Dadasaheb Phalke International Film Festival
Award in 2025 and the film was also India’s official entry in the Best
International Feature Film category at the 97th Academy Awards.
30. It is stated that Plaintiff forayed into Bhojpuri Cinema in 2003 with
his debut film Saiyaan Hamar, which was a phenomenal commercial
success in the box office and turned the Plaintiff into a superstar in the

Bhojpuri film industry overnight. In 2006, Plaintiff played one of the lead
roles in the film Ganga, the first ever Bhojpuri film with an ensemble cast of
veterans and superstars such as Amitabh Bacchan and Hema Malini as also
Manoj Tiwari. The film earned over Rs.35 crores at the box office at the
time of its release itself. Plaintiff can also boast of acting in several popular
Bhojpuri films including action dramas Rama Balrama (2007), Rangbaz
Daroga (2009), Devra Bada Satawela (2010), Satyamev Jayate (2010) and
romance dramas such as Pandit Ji Batai Na Biyah Kab Hoi (2005) and
Lahariya Loote Ae Raja (2010), all of which were huge commercial
successes. In 2008, Plaintiff voiced Hollywood star Tobey Maguire’s role as
Spider-Man in Spider-Man 3 in its Bhojpuri dubbing and the film was the
first Hollywood blockbuster film to include a Bhojpuri voice dub along with
Hindi, Tamil and Telugu dubs. Plaintiff is also a well-known figure to non-
Bhojpuri audiences and made his debut in Telugu film industry in 2014 in
the blockbuster action-comedy Race Gurram, followed by major roles in
films Okka Ammayi Thappa (2016), Kick 2 (2016), LIE: Love Intelligence
Enmity (2017), MLA (2018), 90 ML (2019) and more recently Daaku
Maharaaj (2025). In 2017, Plaintiff made his debut in the Kannada film
industry with the film Hebbuli, starring in a negative role opposite Kannada
superstar Sudeep.
31. It is stated that aside his rich and established heritage on the big
screen, Plaintiff has remained prolifically active on television and has
featured in a number of reality TV shows and soap opera. Plaintiff debuted
on television in the role of Lord Krishna in the mythological drama Jai
Hanuman (1997), followed by soap operas such as Zindagi Mil Ke

Bitayenge (1997), Vishnu Puran (2000-2002) and Yeh Hawaayein (2003-
2004). Plaintiff played the titular role of Inspector Vijay in edge of the seat
cop thriller Hello Inspector (2002-2003), produced by Sri Adhikari Brothers
Television Network Limited (SABTNL) and aired on Doordarshan TV. In
2006, Plaintiff was in the reality TV show “Bigg Boss” in its inaugural
season and came second runner up, which immensely enhanced his
popularity among TV audiences. Incidentally, Plaintiff’s famous signature
catchphrase “Zindagi jhand ba, phir bhi ghamand ba” was first spoken on
this show. Plaintiff also returned to the Bigg Boss show as a guest in Bigg
Boss OTT-3 and more recently appeared in Bigg Boss-18 (2024) as a co-
host/special guest alongside Salman Khan. Plaintiff was also a part of Jhalak
Dikhla Ja show and won many hearts showcasing his dancing skills.
Plaintiff played the lead role in Mamla Legal Hai (2024-), which was
released on OTT and once again proved his stellar acting skills. Apart from
the acting world, Plaintiff has equally excelled in the field of politics, in
which he started his journey in 2014 and during his successive tenures as
Member of Parliament, he has focussed on cultural policies, youth
empowerment, infrastructure development as also brought reforms in diverse
sectors such as cinema, education and health. Plaintiff has been a recipient of
many awards and accolades as detailed in paragraph 34 of the plaint, which
include the Best Actor Awards in Bhojpuri films consecutively from 2006 to
2010 as also the Filmfare Award in 2025 and earlier the IIFA Award in the
category of Best Supporting Actor for his role in Laapata Ladies. In 2025,
Plaintiff also received the Sansad Ratna Award for his exemplary
performance in parliamentary duties, which is a testament of his stellar

record as a Politician and Electoral Representative. Plaintiff has over 3
million followers on Instagram, more than 1 million on Facebook and
several lakhs on other social media platforms, which reflects his fan
following.
32. It is stated that Plaintiff’s commercial entity is intertwined with the
attributes of his personality/persona such as his image, name and likeness,
which are exclusively associated with the Plaintiff and there is no gainsaying
that he enjoys personality/publicity rights over all facets of his personality
and reserves the right to restrain third parties from misappropriating or using
or imitating any facet of his personality and/or to exploit the same
commercially, in any manner whatsoever, without the consent and/or
express authorization of the Plaintiff. Plaintiff’s iconic and renowned stage
name Ravi Kishan is exclusively associated with the Plaintiff and no one
else. Plaintiff’s name along with his image, likeness, voice, signature
catchphrases and persona carry enormous goodwill and reputation and the
name ‘Ravi Kishan’, owing to three decades of presence on public
platforms, brings to the minds of audiences his image/likeness. Present suit
is filed by the Plaintiff seeking protection of his personality/publicity rights
as also statutory protections under the Trade Marks Act, 1999 (‘1999 Act’)
and the Copyright Act, 1957 (‘1957 Act’).
33. It is stated that Defendants No.6 to 20 are violating the personality
rights of the Plaintiff by uploading pornographic content using Plaintiff’s
name as keyword on the webpage and as part of URLs, which is causing
irreparable damage to Plaintiff’s image and reputation in public and the
respective DNRs and intermediaries are permitting the hosting of the

offending content. Defendant No.1 has posted audios and videos of vulgar
songs with captions superimposed on a video featuring the Plaintiff at a
religious ceremony with a political leader of a State which wrongfully
suggests that Plaintiff is a political middleman. Audios/voiceovers have been
uploaded containing profanity superimposed on a video clip from an
interview of the Plaintiff and portrays him as an incompetent elected
representative. Another AI generated video shows content which makes fun
of Plaintiff’s diction. Defendant No.29 is a Media Production and Broadcast
company that owns a radio channel. Defendant No.5 has engaged in
violation of Plaintiff’s personality rights by unauthorizedly using his name,
image and likeness for a radio programme on the channel Ishq 104.8 FM by
distorting Plaintiff’s name Ravi Kishan in the radio programme ‘What is
Love with Kavi Kishan’, as detailed in the plaint.
34. Learned Senior Counsels for the Plaintiff submit that Plaintiff is a
highly reputed and celebrated actor as also elected Member of Parliament
with immense goodwill, reputation and public recognition earned through
decades of hard work in the film industry across all languages. Plaintiff’s
name, image and persona have immense commercial value and are a source
identifier and these aspects of his personality are exclusively associated with
the Plaintiff and no one else. Over the years, Plaintiff has acquired
substantial and enforceable personality/publicity rights in relation to his
official name, screen name, image, voice, likeness, signature catchphrases,
mannerisms and other distinctive characteristics of his persona, which
constitute valuable intellectual property protected under the provisions of
1999 Act and 1957 Act. Defendants, as detailed in the plaint, are violating

Plaintiff’s personality and publicity rights by commercially exploiting his
persona and reputation by monetizing infringing content through various
social media platforms, without his authority/consent/permission and prior
knowledge.
35. It is urged that Defendant No.1 and other unidentified persons
operating multiple Instagram accounts have uploaded and circulated
infringing Instagram reels using Plaintiff’s personality attributes without
authorization and the content is extremely vulgar, obscene and offensive
which is resulting in humiliating the Plaintiff and tarnishing his image
amongst millions of viewers. Defendants No.4 and 5 have circulated,
fabricated and false statements on X and Facebook by associating the
Plaintiff with statements which he never made and by attributing to him
political and personal opinions. Defendants No.6 to 20 have unauthorizedly
used Plaintiff’s name in relation to sexually explicit and pornographic
content and posted the same on various websites, which is seriously
damaging and tarnishing Plaintiff’s goodwill, reputation and image built
through hard work over three decades. The social media accounts have
amassed substantial public reach and the uploaded content is being widely
disseminated unlawfully.
36. Having heard learned Senior Counsels for the Plaintiff and on perusal
of the documents as also averments in the plaint, I am of the view that
Plaintiff has made out a prima facie case for grant of ex parte ad interim
injunction. Balance of convenience lies in favour of the Plaintiff and he is
likely to suffer irreparable harm in case interim injunction is not granted.
37. Plaintiff is a renowned, popular as also well-respected actor with an

illustrious career spanning over three decades. From the start of his journey
in 1992 in Hindi film Pitambar to now, he has garnered enviable reputation
and goodwill through his acting skills coupled with his contributions to the
society as a politician. As noted above, Plaintiff has played significant and
memorable roles in many commercially successful films such as Tere Naam,
Phir Hera Pheri, Son of Sardaar-2 and most recently, Laapata Ladies, for
which he was bestowed the prestigious Dadasaheb Phalke International Film
Festival Award and in which his acting was appreciated by one and all.
Plaintiff is also the recipient of Bhojpuri Film Awards for 5 consecutive
years as also the IIFA Award for Laapata Ladies. Plaintiff has also made
significant contributions in the Bhojpuri Film Industry and has left an
unforgettable impression for his debut film Saiyaan Hamar which was a
phenomenal commercial success. Plaintiff has starred in over 750 films
spanning across genres, languages and audiences. He has to his credit many
unforgettable roles in mythological dramas as also television reality shows
such as Jhalak Dikhla Ja, where his dancing skills came to light. Plaintiff’s
role in OTT release Mamla Legal Hai has been widely acclaimed across all
sections of the society. Even in the field of the politics, Plaintiff has made
significant contributions towards empowerment of youth and worked
towards infrastructure development as also development and reforms in
education, cinema and health sectors and was awarded the Sansad Ratna
Award for exemplary performance in parliamentary duties. As rightly
flagged by the Plaintiff, he has the exclusive right to protect the various
attributes of his personality such as name, image, voice, likeness and restrain
third parties from using and commercially exploiting these attributes without

his express permission and authority.
38. Personality rights are now judicially recognized as also the need to
protect them. In Jaikishan Kakubhai Saraf v. Peppy Store and Others,
2024 SCC OnLine Del 3664 and Aishwarya Rai Bachchan v.
Aishwaryaworld.com and Others, 2025 SCC OnLine Del 5943, this Court
held that when attributes of famous personalities are used unauthorisedly, it
leads not only to commercial detriment but also impacts his/her rights to
privacy/personality and live with dignity. Plaintiff is thus entitled to
complain against any content which violates his personality rights and/or is
vulgar or obscene or has sexually explicit or pornographic content and
tarnishes his image, goodwill and reputation in the public and amongst
family and friends and seek protection as well as action against the
wrongdoers.
39. Accordingly, till the next date of hearing:-
(i) Defendants No.1 to 20 and 29 (including John Does) and all others
acting on their behalf are restrained from violating Plaintiff’s
personality rights by utilizing and/or in any manner, directly or
indirectly, using or exploiting or misappropriating Plaintiff’s
personality/publicity rights by use of Plaintiff’s (a) name “Ravindra
Shukla” and “Ravi Kishan”; (b) image and likeness; and (c) any
other attributes of Plaintiff’s persona which are exclusively
identifiable with him for any commercial and/or personal gain
through the use of any technology including but not limited to
Artificial Intelligence, Generative Artificial Intelligence, Machine
Learning, Deepfakes and/or any medium and formats including butCS(COMM) 680/2026 Page 12 of 16

not limited to physical/virtual/social media.
(ii) Defendants No.1 to 20 and 29 are further restrained from posting
any audio-visual content, videos etc. posting vulgar/obscene/
pornographic content using any attribute of Plaintiff’s personality
such as his name, image, likeness through use of any technology
including but not limited to Artificial Intelligence, Generative
Artificial Intelligence, Machine Learning, Deepfakes and/or any
medium and formats including but not limited to physical/
virtual/social media.
(iii) Defendants No.1, 3 to 20 and 29 and the respective DNRs
Defendants No.21 to 28 are directed to take down the respective
URLs mentioned in Annexure-A to this order within a period of
three days from the date of receipt of copy of this order. In case the
needful is not done by the said Defendants, it shall be open to the
Plaintiff to bring this to the notice of Defendant No.30/Meta
Platforms, Inc., Defendant No.31/Google LLC and Defendant
No.32/X Corp., as the case may be and the said Defendants shall
initiate steps to take down the URLs concerning them, within 72
hours from the date of receipt of intimation from the Plaintiff in
this regard.
40. Plaintiff shall comply with the provisions of Order XXXIX Rule 3
CPC within a period of two weeks from today.
