01. Through the medium of the instant application supported with an affidavit,
the applicant, seeks extension of order dated 11.03.2026, passed in CrlM
No. 233/2026, whereby, he has been granted bail in case FIR No. 294/2020
of Police Station, Udhampur, under Sections, 302, 201, 120-B IPC, 4/25 of
Arms Act on health grounds for a period of six weeks, expiring on
22.04.2026, on the grounds that he has been diagnosed as a documented
case of CA Rectum being registered under SCI No. 230/26, dated
02.02.2026 and is undergoing treatment including administration of
Chemotherapy.

02. Heard learned counsel for the applicant in respect of the matter and
considered his submissions.

03. Perused the application supported with an affidavit. Also perused the main
application which is listed for hearing on 22.04.2026.

04. Perusal of the copies of the medical records placed on the record of the file,
reveals that the applicant is a documented case of a Moderately
Differentiated Adenocarcinoma Rectum and is presently undergoing
treatment.

05. As per the terms and conditions appended to the order dated 11.03.2026,
applicant has to surrender before the Superintendent of Jail concerned on
22.04.2026.

06. The respondent is directed to file objections to the instant application
positively by the next date hearing.

07. Having regard to the ailment of the petitioner and the fact that he is
undergoing treatment, it shall not meet ends of justice to direct him to
surrender before the Superintendent of Jail concerned on 22.04.2026.

08. The merits of the case do not apply when the bail is sought on exclusive
humanitarian grounds. A prima facie and justified ground appears to be
made out in the circumstances of the case for extension of the bail already
granted in favour of the applicant vide order dated 11.03.2026 so as to
enable him to undergo the treatment for his deadly disease.

09. Accordingly, the temporary bail already granted in favour of the applicant
vide order dated 11.03.2026 is extended for a further period of eight weeks
by which time the respondents shall file its objections to this application.

10. List this application along with main application on 06.06.2026.
