Heard learned counsel for the petitioner and learned APP
for the State.
2. The petitioner seeks bail in connection with Sultanganj
P.S. Case No. 02 of 2026 instituted for the offences under Sections
292, 272, 3(5) of the Bharatiya Nyaya Sanhita and under Sections 21,
22 of N.D.P.S. Act, under Sections 25 (1-b) a/26 of Arms Act, under
Section 30(a) of Bihar Prohibition and Excise Act and under Section
3, 4 of Explosive Substance Act.
3. The petitioner was arrested with narcotic, i.e. ten tablets
of Nitrazenpam, a country made pistol and 750 ml of liquor along
with Rs. 2,52,200/-.
4. Learned counsel for the petitioner relies upon
Annexure-2 to show that the petitioner is a mentally challenged
person and the recoveries have been planted as his mother is in the
Police Department and due to animosity with her, the same has been

done. The petitioner is in custody since 03.01.2026 and has got two
criminal antecedents in which he is on bail.
5. Learned A.P.P. for the State has vehemently opposed
the prayer for grant of bail to the petitioner.
6. Considering Annexure-2, this Court is inclined to grant
bail to the petitioner.
7. Let the petitioner be released on bail after framing of
charge, if not already framed on furnishing bail bonds of
Rs.10,000/- (Ten thousand) with two sureties of the like amount each
to the satisfaction of learned Principal Sessions Judge,
Bhagapur/concerned Court in connection with Sultanganj P.S. Case
No. 02 of 2026.
8. It is made clear that any observation made herein is
prima facie in nature and limited solely for the purpose of
adjudication of the present bail application. Such observations shall
not be construed as an expression on the merits of the case and shall
not influence the trial or any other proceedings in any manner.
