    1. Present petition has been filed under Article 226/227 of the

    Constitution of India read with Section 5 of the Haryana Good Conduct

    SPONSORED

    Prisoners (Temporary Release) Act, 2022, seeking issuance of a writ in the

    nature of certiorari to set aside the impugned order dated 09.04.2026 issued

    by respondent No.4, whereby the request of the petitioner, Randeep Singh

    alias Kala, aged 35 years, for release on parole for a period of three weeks.

    2. Petitioner has prayed for grant of parole for 03 weeks on the

    ground that his minor son is suffering from neurological ailment and regular

    care is required of him. Proper treatment could not be given to the child

    because petitioner is inside jail. On hearing the counsel on 13.05.2026, the

    following was recorded.

    3. In the status report dated 24.05.2026 filed by the State

    (Annexure R-1). The State has filed the report regarding the family and

    ailment of the child and same reads as under:-

    “With reference to your office memo No. 5030 dated 22.05.2026
    regarding prisoner No. CT-7014/2025, Randeep alias Kala son of

    who has applied for 3 weeks emergency parole, verification was
    conducted in the village by ASI Rajbir Singh No. 535/Jind through
    the concerned persons. During inquiry, it was found that the family
    of prisoner Randeep alias Kala consists of his (parents) and wife
    Suman. Prisoner Randeep and Sonu are two brothers and both are
    married. Sonu resides separately at Jind along with his children. It
    also came to notice that prisoner Randeep has one daughter, Khushi
    aged about 17 years, and one younger son Himanshu aged about 3
    years and 5 months. It was informed that his son is suffering from a
    spinal bifida disease related problem in the waist/spinal area and is
    presently undergoing treatment at SUNFLAG GLOBAL HOSPITAL,
    ROHTAK. Copies of the medical documents have been produced and
    are enclosed herewith. Further verification was also conducted from
    the concerned doctor at SUNFLAG GLOBAL HOSPITAL, ROHTAK,
    who informed that surgery/operation of Himanshu has been advised
    and time for the same has been given in the first week of June 2026.
    Prisoner Randeep alias Kala has filed an application before the
    Hon’ble High Court seeking emergency parole for treatment of his
    son Himanshu. Prisoner Randeep alias Kala is undergoing sentence
    in case FIR No. 01 dated 01.01.2008 under Sections 364 IPC and
    25/54/59 Arms Act, Police Station Naraiangarh, and is presently
    lodged in District Jail, Jind.”

    4. Apart the aforementioned added facts it has also been

    mentioned that petitioner is having long history of involvement in the

    criminal cases and thereupon details in particular regarding 17 cases have

    been mentioned. As per paragraph No.3 of the status report details of all 17

    cases have been provided and details of such cases as under:-

    i. FIR No. 131 dated 31.12.2010 under Sections 307 IPC and
    25/54/59 Arms Act, Police Station Alewa, registered case;
    convicted on 05.01.2012.

    ii. FIR No. 84 dated 15.02.2006 under Sections 11-59-60 PC Act
    and C.S. Act, Police Station City Jind; case registered and
    discharged. by the Hon’ble Court.

    iii. FIR No. 01 dated 01.01.2008 under Sections
    363
    /364/212/120-B IPC, Police Station Narwana; acquitted
    PRIYANKA by the Hon’ble Court.

    iv. FIR No. 594 dated 03.11.2007 under Sections 307/34 IPC and
    Arms Act, Police Station City Jind; pending trial before the
    Court.

    v. FIR No. 108 dated 07.07.2011 under Sections 302/148/149
    IPC and Arms Act, Police Station Rajound, Kaithal; acquitted
    by the Hon’ble Court.

    vi. FIR No. 111 dated 02.08.2011 under Sections 25-54-59 Arms
    Act
    , Police Station Uchana; pending trial before the Court.

    Sadar Jind; convicted by the Hon’ble Court.

    by the Hon’ble Court.

    ix. FIR No. 250 dated 29.03.2013 under Section 42 Prisoners
    Act, Police Station City Jind; acquitted by the Hon’ble Court.
    x. FIR No. 228 dated 26.12.2016 under Sections 25/30/54/59
    Arms Act, Police Station Alewa; convicted on 01.09.2022.
    xi. FIR No. 121 dated 10.07.2017 under Section 8/9 G.D. Act,
    Police Station Alewa; convicted on 06.02.201.
    xii. FIR No. 225 dated 29.08.2017 under Sections 307/34 IPC and
    25-54-59 Arms Act, Police Station Sadar Narwana; acquitted
    by the Hon’ble Court.

    xiii. FIR No. 148 dated 04.09.2017 under Sections 392/506 IPC
    and 25-54-59 Arms Act, Police Station Alewa; acquitted by
    the Hon’ble Court.

    xiv.FIR No. 77 dated 02.06.2013 under Sections 307/148/149/302
    IPC, Police Station Alewa; discharged by the Hon’ble Court
    on 19.12.2016.

    xv. FIR No. 158/2017 under Section 307 IPC and 25-54-59 Arms
    Act
    , Police Station Bhiwani; acquitted by the Hon’ble Court
    on 31.08.2022.

    xvi.FIR No. 759/2018 under Sections 323/324 IPC, Police Station
    Sadar Karnal; case cancelled on 04.03.2020.
    xvii. FIR No. 129 dated 23.05.2025 under Sections 229, 318(4),
    338, 336(3), 340(2) BNS and 323/324 IPC, Police Station

    From aforementioned details it comes out that in the cases

    mentioned at Sr. No. i, vii, x, xi. Petitioner was convicted, however, in the

    cases mentioned at Sr. No.ii, iii, v, viii, ix, xii, xiii, xiv, xv and xvi. Petitioner

    was either discharged or was acquitted by the respective Courts.

    5. Proceedings regard to the cases mentioned at Sr. Nos. iv, vi and

    xvii are pending. Therefore, prima facie considering the purpose of the Act

    i.e. Haryana Good Conduct Prisoners (Temporary Release) Act, 2022 for the

    purpose of releasing of the petitioner on parole cannot be applied so strictly

    as has been depicted by the State in his status report. Court has seen the

    medical report as well as photographs (Annexure P-2) and other relevant

    medical record which clearly shows that the child is suffering measurable

    pathetic condition and he need urgent medical care. If the prayer of

    petitioner is rejected, it would be it may cause damaged to the life of infant

    child without too providing any proper care by some responsible person.

    6. However, by referring to the judgment of the Hon’ble Division

    Bench of this Court in the case titled ‘Kulwinder Singh @ Taina vs. State of

    Punjab and Others‘ 2024 (3) Law Herald 872, Law Finder Doc ID

    #2592372, and the judgment of this Court in ‘Karanpreet Singh alias Giana

    alias Fateh vs. State of Punjab and Others‘, passed in CRWP-344-2025,

    decided on 01.03.2025, learned counsel submits that in view of the purpose

    behind granting parole as a rehabilitative measure, the petitioner ought to be

    released on parole for a period of eight weeks. Accordingly, prays for

    quashing of the impugned order. The beneficial purpose of the discretion has

    already been discussed.

    7. Though petitioner has prayed for release of petitioner 03 weeks,

    however, considering the circumstances in entirety and the ailment with

    PRIYANKA which his child is suffering may require ample time for providing treatment

    and for the said purpose, petitioner is ordered to be released on parole for a

    period of 08 weeks from the date of receipt of certified copy of this order,

    and subject fulfiling all the required formalities to the satisfaction of District

    Magistrate, Jind. Thereupon, petitioner be released on parole immediately by

    the Jail authorities as per law. Copy of this order be also forwarded to the

    concerned Jail authorities.

    However, it is made clear that petitioner if found misusing the

    concession, immediately he will have to surrender back to the Jail thereon or

    the Police may also go to arrest him. It would be expected that he will not

    get involved in any other activity except of taking care of his child and the

    family members.

    Further, petitioner is directed to surrender back before the Jail

    authorities on 11.09.2026 by 5:00 P.M.

    Petition stands disposed of.

    8. Before parting, it is apposite to notice that in the status report

    dated 24.05.2026 filed by the respondent-State, in Para No.3 it has been

    stated that the minor son, namely, Himanshu, of the petitioner, who is

    suffering from neurological ailment, is undergoing treatment at Sunflag

    Global Hospital, Rohtak. Further it has also been mentioned that

    surgery/operation of Himanshu was scheduled to be held in the first week of

    June, 2026. Even photographs of the child have been appended with the

    present petition as Annexure P-2, showing his ailment/condition.

    9. In this view of the matter, this Court is of the considered view

    that the financial position of the petitioner and his other family members as

    regards to bear the expenses of the treatment of his minor son in a

    specialized hospital, is required to be ascertained so that proper treatment

    State counsel is directed to get the financial status of the petitioner and his

    family members ascertained through the concerned Deputy Commissioner of

    the District to which the petitioner belongs. The report in that regard be

    placed before this Court within one week.

    10. For considering this said aspect of the matter, Registry is

    directed to list this case on 17.07.2026.
