1. Writ Petition No. 243 of 2024 was filed impugning the order
passed by the Deputy Collector and Presiding Officer of the Tribunal
for Maintenance and Welfare of Parents and Senior Citizens, Mumbai
City, cancelling the Gift Deed by which the tenancy of the subject
property had been transferred in favour of the Petitioner by
Respondent No. 1, the grandfather of the Petitioner.
2. During the pendency of the Writ Petition, the Respondent No. 1,
who was the beneficiary of the impugned order, expired, and the
contention which was raised on behalf of the Petitioner was that not

only the Appeal abates, but the relief enjoyed by Respondent No. 1
would also abate, and the impugned order would stand effaced.
