1. The present Writ Petition has been filed under Article 226 of
the Constitution of India read with Section 528 of the Bharatiya
Nagarik Suraksha Sanhita, 2023 (‘BNSS’), seeking issuance of a Writ
in the nature of Habeas Corpus, directing the respondents to produce
Ms.Ruqyya.

2. Pursuant to our order dated 15.04.2026, the amended memo of
parties has been filed by the petitioner. The same is taken of record.

interacted with her, her father, that is, the respondent no.2, and the
petitioner.

4. Ms. Ruqyya has emphatically stated that she wishes to reside
with the petitioner and in fact the petitioner and Ms.Ruqyya are going
to get married soon. The petitioner, of course, wishes for her to come
and reside with him.

5. As far as the father of Ms.Ruqyya is concerned, he seems to be
opposed to the alliance of his daughter and the petitioner. He states
that if she chooses to go with the petitioner, he shall not like to have
any contact with her in the future.

6. Be that as it may, as Ms.Ruqyya is major and has decided to
reside with the petitioner, she shall be free to do so.

7. Keeping in view the sensitivity of the issue involved and
apprehension expressed by the petitioner, we request the learned
Counsel for the State to ensure that the petitioner and Ms.Ruqyya are
provided with an escort to drop them at the place where they wish to
reside for the present.

8. The Beat Constable of the concerned area will also share his/her
number with the petitioner and Ms.Ruqyya, so that they may contact
him/her in case of any emergency.

9. The petition is disposed in the above terms.
