appearing for the respondent – State on advance
notice has vehemently opposed the grant of bail.

Reason:
2025, registered at P.S.: Women Police Station,
District: West Champaran, for the offences
punishable under Sections 64, 65(1), 143(1), 145,
95, 3(5) of Bharatiya Nyaya Sanhita, 2023,
Sections 6, 8 and 12 of Protection of Children
from Sexual Offences Act, 2012 and Sections 75
and 79 of Juvenile Justice Act, 2015, Sections 3,
4, 5 and 6 of the Immoral Traffic (Prevention)
Act,1956 and Sections 16, 17, and 18 of the
Bonded Labour System (Abolition) Act, 1976, are
seeking regular bail.
4. The record would disclose that investigation
is concluded and charge-sheet has been filed and
two witnesses have already been examined.
5. It is the case of the prosecution that minor
girls were found in various orchestra groups had
been trafficked and they were sexually exploited.
Even according to the FIR, the appellants were
neither the owner nor Manager of the orchestra
group and they were only the employees
(Announcer) in Chhoti New Musical Orchestra

Dhamaka Group.
6. It is also pertinent to note at this
juncture, for the limited purpose of considering
the prayer for bail, that the statements of the
rescued girls which have been recorded under
Section 183 of Bharatiya Nagarik Suraksha
Sanhita, 2023, particularly of the two victims
associated with the orchestra group where
appellants were working are perused and same
would disclose that there were no evidence of
sexual assault. The three co-accused Gena Sah,
Rajat Sardar @ Rajjat Kumar @ Rajat Kumar and
Subhash Kumar have been granted regular bail by
the jurisdictional High Court. Hence, appellants
are also entitled for grant of bail on the ground
of parity.
7. As such, the impugned order dated 15.05.2026
passed by the High Court is set aside and
appellants are ordered to be released on bail on
such terms and conditions as the jurisdictional
court deems fit to impose, including the

condition of directing the appellants to appear
before the trial court on all dates of hearing
except when specifically exempted.
8. The appeals are allowed in the above terms.
9. Pending application(s), if any, shall stand
disposed of.
