O R D E R
1. This transfer petition has been filed by the petitioner
(husband) seeking transfer of Petition No. 321 of 2024 titled
as Shubhangi Sharma vs. Raghu Sharma filed by the respondent
(wife) under Section 13-A(ia)(ib) of the Hindu Marriage Act,
1955 from the court of the First Family Judge, District Udham
Singh Nagar (Uttarakhand) to a court of competent jurisdiction
at Gurugram, Haryana.
2. As per order dated dated 09.10.2025, the matter was
referred to the Supreme Court Mediation Centre where the
parties have settled their dispute amicably and the report of
the mediation dated 20.01.2026 has been received.
3. In furtherance to the terms of the settlement agreement,

respondent and the petitioner husband has already paid a sum

of Rs.50,00,000/- towards permanent alimony, stridhan,
maintenance (past, present and future) to the wife. As
contended before us, it is merely a car bearing Registration
No. PB 02 BS 6666 to be transferred in the name of the
respondent (wife) on the cost to be borne by the petitioner
(husband). In the said process, both parties are required to
cooperate in transfer of the registration for which both have
agreed. It is to be noted that since the amount has already
been paid, therefore, the cheque No. 000128 dated 10.04.2026
drawn on the ICICI Bank, Batala Road, District Amritsar,
Punjab amount to Rs.20,00,000/- (Rupees twenty lakhs only) be
returned to the petitioner (husband).
4. The petitioner is personally present in Court and the
respondent (wife) joined virtually. They have been
identified by their respective counsel. We have interacted
with the parties. They have agreed to the terms of the
settlement and stated to abide those terms. They further
agreed to grant a decree of divorce by mutual consent.
5. Both parties have filed IA No. 42551 of 2026 seeking
dissolution of marriage under Article 142 of the Constitution
of India seeking decree of divorce by mutual consent in view
of the settlement as arrived at between them.

6. Considering the aforesaid, we are inclined to accept the
settlement agreement and to dispose of this Transfer Petition
with the following directions :
(i) The amount of Rs.50,00,000/- (Rupees fifty lakhs only)
has been paid to the respondent (wife) by the
petitioner (husband) and are accepted by the respondent
towards permanent alimony, stridhan, maintenance (past,
present, future) and by virtue of the same, she would
not have any other claim in the movable or immovable
properties of the husband or his family.
(ii) All the criminal/civil cases, as stated in paragraph 3
of the Settlement Agreement, pending between the
parties against each other shall stand quashed/disposed
of.
(iii) FIR No.221 of 2016 under Sections 498-A, 406, 354, 324,
504 and 506 of Indian Penal Code, 1860 and Sections 3
and 4 of the Dowry Prohibition Act registered with
Police Station Transit Camp, district Udham Singh Nagar
against the petitioner husband and his family members
stands quashed.
(iv) Accepting the terms of the settlement and as consented
by the parties, on their request in exercise of our

jurisdiction under Article 142 of the Constitution of
India, we grant the decree of divorce by mutual
consent. Consequently, the marriage between the
petitioner-husband (Raghu Sharma) and the respondent-
wife (Shubhangi Sharma) shall stand dissolved. By an
outcome of the dissolution of marriage, the parties are
set free to lead their lives separately as per their
own will.
(v) A copy of this order be communicated to the courts
concerned where the cases between the parties are
pending. On communications the pending cases shall be
treated as disposed of and consigned to records.
7. Ordered accordingly. Pending applications, if any, shall
stand disposed of.
