    Heard with the aid of case diary / challan papers.

    2. This is first bail application under Section 483 of the Bhartiya
    Nagarik Suraksha Sanhita, 2023/Section 439 of Code of Criminal Procedure,
    1973 for enlargement of the applicant on regular bail in connection with
    crime No.159/2026 registered at Police Station Manpur, District Indore,
    Mandsaur (M.P.) for offence punishable under Sections 74, 75(2), 76, 79,

    82(2), 296(B), 115(2), 351(3) and 3(5) of B.N.S. and Section 67 and 67(A)
    of I.T. Act. The applicant is in custody since 25.05.2026.

    3. As per the prosecution case on 21/04/2026 at 7.51 PM the
    complainant alleges that she was married with Ramesh since last eight nine
    years. That, it is alleged that the husband of the complainant Ramesh has
    married with another lady Gauri. That, it has also been alleged that on

    18/04/2021 at about 2 P.M the husband Ramesh, second wife Gauri and
    mother in-law quarreled with complainant and torn her clothes and cut her
    hairs. That, it is also alleged that the husband of complainant on 21/04/2026
    has sent obscene video of the complainant to her brother. That, in the video it
    is alleged that present applicant and second wife Gauri helped the husband
    Ramesh cut her hairs and torn her clothes. That, applicant has been
    implicated as an accused for offence under 43 section 74, 75(2), 76, 79,
    82(2), 296(B), 115(2) 351(3) and 3(5) of BNS and section 67 and 67(A) IT
    Act in Crime No.159/2026.

    4. Learned counsel for the applicant submits that the applicant has
    been falsely implicated in the present case. There is no possibility of his
    absconding and there is no possibility of tampering with the witness. He has
    no criminal past and has been in custody since 25.05.2026. Conclusion of
    trial is likely to take sufficient time. Hence, he prays that the applicant
    deserves to be enlarged on bail.

    5. Per contra, learned counsel for the respondent/State opposes the
    prayer for grant of bail.

    6. On due consideration of the submissions of the learned counsel for
    the parties and the fact that the applicant has no criminal past, this Court is
    inclined to allow this application.

    7. Accordingly, without commenting on the merits of the case, the

    application is allowed. It is directed that applicant be released on bail upon his /

    her furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand
    Only) with one solvent surety in the like amount to the satisfaction of the
    concerned court / JMFC for his / her regular appearance before the trial Court

    during trial with a condition that he / she shall remain present before the
    concerned Court on all the dates fixed by it during trial. He / She shall abide by
    all the conditions enumerated under Section 480 (3) of BNSS /Section 437 (3) of
    Cr.P.C.

    8. This order shall be effective till the end of the trial. However, in case of
    bail jump and breach of any of the conditions of bail, it shall become ineffective.
