02/ 09.03.2026: This bail application has been filed under Sections 483 & 484 of
BNSS, 2023 wherein, prayer has been made for grant of bail as they
are in custody for allegedly committing offence punishable under
Sections 302, 341, 323, 325, 427, 504, 506, 34 of the Indian Penal.
2. Heard, learned counsel for the petitioners, learned counsel for
the State, learned counsel for the informant and have also gone
through the impugned order.
3. Learned A.P.P. and learned counsel for the informant opposes
the prayer for bail.
4. The allegation against these petitioners is that they assaulted the
informant and the family members of the informant. Thereafter, the
case was registered originally under Sections 341, 323, 325, 427, 504,
506, 34 of the Indian Penal Code. These petitioners appeared before
the Trial Court and vide order dated 27.06.2023, they were released
on bail. Since, the deceased died after one month, Section 302 of IPC
was also added.
5. In this case, the chargesheet has already been submitted. The
death has occurred after 20 days of the assault and the petitioners
were already on bail and there was no adverse reporting against these
petitioners.
6. Considering the aforesaid fact and the fact that petitioners are in
custody since 25.11.2025, I am inclined to grant bail to these
petitioners. Accordingly, the petitioners, named above, are directed
to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees
Ten Thousand) each with two sureties of the like amount each to the
satisfaction of the learned Chief Judicial Magistrate at Chaibasa in
connection with Chaibasa Sadar Police Station Case No.65 of 2023
subject to the condition that one of the bailors should be a close
relative of the petitioners, having sufficient landed property in his
own name within the State of Jharkhand.
