    1.The present Special Leave Petition calls in question

    the correctness of the judgment and order dated
    2

    11.11.2025 in SBCRMA for Suspension of Sentence

    No.2385/2024 in SBCRLA No.245/2023 passed by the High

    Court of Judicature for Rajasthan at Jaipur.

    2. The High Court refused to suspend the sentence of

    the petitioner pending trial. The petitioner was

    convicted by the Special Judge, Ajmer, Rajasthan in

    Sessions Case No.12/2022 for the offences punishable

    under Sections 450 and 456 of the Indian Penal Code and

    Sections 5(L)/6 and 3/4 of the Protection of Children

    from Sexual Offences Act, 2012 (for short, ‘POCSO Act’)

    and sentenced to various period of imprisonment, the

    highest of there being 20 years under Sections 5(L)

    read with 6 of the POCSO Act. The petitioner has

    undergone five years of the imprisonment.

    3. With the assistance of the learned counsel for the

    parties, we have seen the depositions in vernacular of

    the prosecutrix. We are not venturing to elaborate on

    the merits of the same lest it prejudice to the hearing

    of the appeal. At this stage, we are prima facie

    satisfied that the petitioner has made out a case for

    suspension of sentence and grant of bail pending the

    hearing of his criminal appeal by the High Court.

    4. Accordingly, we direct that pending the hearing of

    S.B.Criminal Appeal No.245/2023 by the High Court of

    Judicature for Rajasthan at Jaipur, the sentence of the

    petitioner shall be suspended and the petitioner shall

    be enlarged on bail subject to such terms and

    conditions that may be imposed by the concerned Trial

    Court.

    5. The Special Leave Petition is disposed of in the

    above terms.

    6. Pending application(s), if any, shall also stand

    disposed of.
