ORDER
This is the first bail application filed by the applicant under Section 483 of
B.N.S.S. for grant of regular bail relating to Crime No.36/2022 registered at Police
Station – Ashoka Garden, District Bhopal (M.P.) for the offence punishable under
Sections 302,307, 324, 294, 506, 34, 323 of IPC and Section 25 of the Arms Act.
Applicant is in detention since 17.01.2022.
2. Learned counsel for the applicant submits that applicant is innocent and
falsely implicated in this case. He is in custody since 17.01.2026. It is submitted
that the material witnesses have been examined before the Trial Court. There is no
possibility of tempering the evidence. Charge sheet has been filed. The conclusion
of the trial will take considerable time. In support of his submission, learned
counsel for the applicant has placed reliance on the decision Apex Court in
Hussain & Anr. vs. Union of India passed in Criminal Appeal No.509/2017 and
decision of High Court of Bombay in Ganesh Madhukar Mendarkar vs. State of
Maharashtra passed in Bail Application No.597/2025 therefore, it has been prayed
that the applicant may be released on bail.

3. On the other hand, learned counsel for State has opposed the grant of bail
to the applicant and has submitted that the applicant alongwith co-accused persons
caused grievous injuries to the deceased Monu Matka @ Vinay Sharma with a
knife due to which he died. They also caused grievous injuries to the injured
persons. From the possession of applicant, one knife and blood stained clothes
have been seized. The applicant has also criminal antecedents of one case
registered at Crime No.173/2019 at P.S. Ashoka Garden, Bhopal under Sections
363, 366, 376(2)(n) of IPC, Section 3(1)(w), 3(2)(v) of S.C. & S.T. (Prevention of
Atrocities) Act and Section 5/6 of POCSO Act. Hence, the applicant does not
deserve grant of bail.
4. Heard learned counsel for the parties and perused the record.
5. In this case, the applicant alongwith co-accused persons have committed
murder of deceased and caused injuries to the injured Neeraj Sharma and Veeru
Singh. He has also criminal antecedents of one case of heinous offence. In such
type of offence, only on the ground of custody period, the applicant should not be
enlarged on bail in the light of the decision of Apex Court in Kalyan Chandra
Sarkar Vs. Rajesh Ranjan @ Pappu Yadav reported in (2004)7 SCC 528 and
Narcotis Control Bureau Vs. Mohit Agarwal passed in Criminal Appeal No.1001-
1002/2022 and State of U.P. Through CBI Vs. Amarnath Tripathi, (2005) 8 SCC

6. Looking to the overall facts and circumstances of the case and the active
participation of applicant in the alleged offence, this Court is not inclined to grant
bail to him.
7. Consequently, this MCRC stands dismissed.
8. The status report received from concerned Trial Court reveals that only

07 prosecution witnesses have been examined and 12 witnesses have to be
examined.
9. Since the applicant is in custody since 17.01.2022 and trial is not
complete,learned Trial Court is directed to conclude the trial within a period of six
months. It is also directed that unnecessary adjournments will be not granted by
the Trial Court and the case be listed at short duration.
10. The Commissioner of Police, Bhopal is also directed to ensure presence
of remaining prosecution witnesses before the Trial Court for giving evidence.
11. Learned Trial Court is also directed to send the progress report of the
trial in every month to the Principal District Judge (Inspection) Jabalpur through
the concerned Principal District Judge, District Bhopal. The Principal District
Judge (Inspection) Jabalpur is also directed to monitor the progress of this case
and submit the progress report after six months.
12. Registry is directed to send a copy of this order immediately to the
concerned Trial Court, Principal District Judge (Inspection) Jabalpur as well as
Commission of Police, Bhopal for necessary compliance.
