Heard with the aid of case diary / challan papers.
This is a repeat (third) bail application under Section 483 of
the Bhartiya Nagarik Suraksha Sanhita, 2023 = Section 439 of Code of
Criminal Procedure, 1973 for enlargement of the applicant on regular bail in
connection with crime No.643 of 2024 registered at Police Station Mahakaal,
District Ujjain (MP) for offence punishable under Sections 118 (1), 115 (2),
296, 351, 3 (5) and 109 of Bhartiya Nyaya Sanhita, 2023. The applicant is in
custody since 06.02.2026. His First temporary bail application was allowed
for a period of one month vide order dated 11.03.2026 passed in
Miscellaneous Criminal Case No.10969 of 2026; and thereafter his

Second application for grant of temporary bail for a period of twelve days
was allowed vide order dated 08.05.2026 passed in Miscellaneous Criminal
Case No.21578 of 2026.
2. As per the prosecution story, on 11.12.2024 at around 09:30 in the
morning injured Surendra Yadav came at Lalpur Bridge and found accused
persons Jitendra Yadav, Parth Yadav (present applicant) and Bharat Thakur
were already waiting for injured person Surendra. Accused persons pushed
Surendra and assaulted. Accused Parth caused injury on face by a brick on
which complainant Mahendra came and intervened on which Jitendra hit him
on back with iron rod. Accused Bharat assaulted both with kicks and fists,
further Parth caused injury with knife and later on ran away. On such,
incident offence under Sections 118 (1), 115 (2), 296, 351 (2) and 3 (5) of
BNS was registered and further during treatment offence under Section 109
of BNS was enacted as the injury was found to be grievous.
3. Learned Senior Counsel appearing for the applicant submits that
the applicant is the nephew of the victim Surendra Yadav and Mahendra
Yadav. The incident dated 11.12.2024 occurred due to irrigation of the
agricultural land through pipeline and replacing the damaged pipeline and
initially the injury is said to have been caused by brick and thereafter using
the knife. Initially, the offence was registered under Sections 118 (1), 115
(2), 296, 351 (2) and 3 (5) of BNS, thereafter after investigation, offence
under Section 109 (1) of BNS was enhanced.
3.1 The applicant is in custody since 06.02.2026. The conclusion of
the trial is likely to take sufficient time. Hence, he prays that the applicant

deserves to be enlarged on bail.
4. Learned counsel for the complainant – objector has opposed the
prayer for grant of bail on the ground that the applicant preferred anticipatory
bail and the same was dismissed and he was directed to surrender before the
Court, but he kept himself unavailable for a period of about one and half
years.
5. Per contra, learned counsel for the respondent / State opposes the
prayer for grant of bail.
6. The criminal record discloses that Crime No.164 of 2026 under
Sections 323, 294, 341 and 506 of IPC was registered against the applicant at
Police Station Dewas Gate, District Ujjain (MP). In this case, a child in
conflict was also involved along with Jitendra. Co-accused Jitendra was
granted benefit of anticipatory bail by this Court vide order dated 29.01.2025
passed in Miscellaneous Criminal Case No.982 of 2025.
7. On due consideration of the submissions of the learned counsel for
the parties and on perusal of the case diary, this Court is inclined to allow
this application.
8. Accordingly, without commenting on the merits of the case, the
application is allowed. It is directed that applicant be released on bail upon his /
her furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand
Only) with one solvent surety in the like amount to the satisfaction of the
concerned court / JMFC for his / her regular appearance before the trial Court
during trial with a condition that he / she shall remain present before the
concerned Court on all the dates fixed by it during trial. He / She shall abide by
all the conditions enumerated under Section 480 (3) of BNSS = Section 437 (3) of

9. This order shall be effective till the end of the trial. However, in case of
bail jump and breach of any of the conditions of bail, it shall become ineffective.
Pending interlocutory application, if any, also stands disposed off.
