            1.

The petitioner has approached this Court by way of filing this
writ petition invoking provisions under Articles 226 and 227 of the
Constitution of India with the following prayer(s):-

“The petitioner therefore prays that this Hon’ble Court may
graciously be pleased to admit this writ application and issue
rule nisi calling upon the opp. Parties to show cause as to why
they shall not be directed to quash the subsequent provisional
merit list in respect of district project manager post is concerned
and the petitioner shall not be considered as selected and
entitled to be appointed for the post in question.
And if the opposite parties fails to show cause or show
insufficient cause, make the said rule absolute by directing them
to give appointment to the petitioner.

And/or to pass such other order/orders direction/directions as
this Hon’ble Court deem just and proper in the facts and
circumstances of the present case.

And for which act of your kindness, the petitioner as in duty
bound shall ever pray.”

2. This Court vide order dated 19th February, 2013 while issuing
notice to the opposite parties passed the following order in Misc.
Case No.21340 of 2012:-

“Heard.

Issue notice as above. Accept one set of process fee.
In the interim, it is directed that, if any post, out of two posts
meant for District Project Manager is lying vacant, one such
post shall not be filled up without leave of this Court.
Urgent certified copy of this order be granted as per rules.”

3. On 6th January, 2026, this Court passed the following order:-

“This Court issued notice on 19.12.2013 to opposite party nos.2
and 3 and passed interim order in misc. case no.21340 of 2012,
but till date no requisites has been filed.

As prayed for by Learned counsel for the petitioner requisites
shall be filed by Friday (08.01.2015), failing which the matter
shall stand dismissed without further reference to Bench.
Interim order passed by 19.02.2013 in Misc. Case No.21340 of
2012 is hereby vacated.”

4. As it appears from the aforesaid order, the interim order has
been vacated.

5. At this stage, learned counsel appearing for the petitioner, by
filing a memo in Court today, submitted that during pendency of this
writ petition, the matter has been rendered infructuous. Therefore, he
sought for leave to withdraw this writ petition. The said memo is
taken on record.
