[1] Heard Mr. N. Jotendro, learned sr. counsel assisted by Md. Syed
Murtaza Ahmed, learned counsel for the petitioner.
[2] The petitioner who holds a degree in Engineering (Civil) applied
for the post of Assistant Engineer in the Public Works Department (PWD), Gov.t
of Manipur, since the year 2016 and the petitioner belongs to person with
benchmark disability (40% locomotor disability). In the recruitment for Assistant
Engineer held in the year 2016, no seat was reserved for Person with Benchmark
Disability (PwBD) and the petitioner applied under the General category. The
petitioner also earlier filed a writ petition being WP(C) No. 351 of 2016 before
this Court for consideration of the candidature of the petitioner in 2016
recruitment under PwBD quota.
[3] Considering the submissions made at the bar, the WP(C) No. 351
of 2016 was disposed of on 05.07.2023 with the observations that the petitioner
may apply for the post of Assistant Engineer in the advertisement to be issued
by Manipur Public Service Commission (MPSC) in terms of the requisition letter
dated 05.06.2017 and it was also observed that the recruitment in terms of the
requisition letter dated 05.06.2017 had already been completed, there is no
requirement of the petitioner for applying against the said post. Later on, the

petitioner has been informed by the Secretary, MPSC about a letter dated
30.06.2025 written to the Commissioner, PWD, Govt. of Manipur stating that the
requisition letter dated 05.06.2017 submitted by the Chief Engineer, PWD,
Manipur to the Commissioner (Works), Govt. of Manipur was not received by the
MPSC. This fact has been confirmed in a RTI reply dated 24.12.2025 given by
the Works Department, Govt. of Manipur stating that the requisition for
recruitment of 19 (nineteen) posts of Assistant Engineers dated 05.06.2017
mentioned in the order dated 05.07.2023 was not implemented and there are
process for recruitment of 39(thirty-nine) Assistant Engineers for Works
Department and the same is under process. Thereafter, MPSC issued a
notification no. 7/1/2026-MPSC(DR) dated 03.02.2026 for direct recruitment of
108 posts of Assistant Engineer/Manager (Civil) in 8(eight) Departments
including 39(thirty-nine) posts for PWD, Govt. of Manipur. Out of this 39(thirty-
nine) posts, 2(two) posts for PwBD are reserved (1 for hearing impaired &
another 1 for locomotor disability).
[4] By the present petition, the petitioner prays for increasing the
number of posts under PwBD quota for the post of Assistant Engineer (Civil) in
PWD, Govt. of Manipur from 2(two) posts to 4(four) posts, directing the
respondents to consider and appoint the petitioner against 1(one) post under
PwBD quota and also to consider & dispose of the detailed representation dated
16.03.2026 submitted by the petitioner to the Commissioner (Works), Govt. of
Manipur.
[5] During the course of hearing, Mr. N. Jotendro, learned sr. counsel
for the petitioner submits that the petitioner has already submitted his
application form for the post of Assistant Engineer (Civil) for the Works
Department, Govt. of Manipur before the last date.
[6] In the circumstances, issue notice to the respondents, especially
about the prayer for increasing the number of posts from 2 posts to 4 posts
under the PwBD quota by considering the principle of carry forward as mandated
under Section 34(2) of the Right of Persons with Disabilities Act, 2016.

[7] Mr. S. Niranjan, learned GA accepts notice on behalf of
respondent nos. 1 & 2 and Mrs. I. Bimola, learned counsel accepts notice on
behalf of respondent no. 3. Hence, service is complete on the respondents.
[8] The learned counsel for the respondents prays for 3(three) week’s
time for filing counter affidavit.
[9] It is made clear that the appointment of 1(one) post under the
PwBD (locomotor disability) quota will be subject to the outcome of the present
writ petition.
