    The petitioner has been made accused in connection with S.T. Case
    No. 272 of 2023 arising out of Chhipadohar P.S. Case No. 04 of 2019
    registered for the offences punishable under Sections 147, 148, 149, 353,
    307 of the I.P.C. and Section 25(1-B)(1-A), 26, 27, 35 of the Arms Act and
    Section 17 of the C.L.A. Act.

    Learned counsel for the petitioner submits that the allegation
    against the petitioner is that the petitioner being a member of extremist
    J.J.M.P. organization attempted to kill the police personnel by firing upon
    them and deterred them from discharging their duties. It is submitted
    that the allegation against the petitioner is false. It is next submitted that
    the petitioner has been implicated in this case only on the basis of
    confessional statement of co-accused Gaju Bhuiyan. It is further
    submitted that some of the co-accused persons including Gaju Bhuiyan
    have been granted bail vide order dated 19.09.2019 in B.A. No. 7246 of
    2019, order dated 21.10.2019 in B.A. No. 8995 of 2019, order dated
    09.07.2020 in B.A. No. 3825 of 2020, order dated 27.11.2025 in B.A. No.
    10276 of 2025, order dated 15.05.2024 in B.A. No. 1755 of 2024. It is then
    submitted that the petitioner undertakes that he will co-operate with the
    trial of the case and will not annoy or disturb the informant or witnesses
    of the case. It is lastly submitted that the petitioner has been in custody
    since 10.10.2025 as mentioned in para-15 of the instant bail application.
    Hence it is submitted that the petitioner be released on bail.

    Learned Addl.P.P. opposes the prayer for bail.
    Considering the facts of this case, the above-named petitioner is
    directed to be enlarged on bail on furnishing bail bond of Rs.25,000/-
    (Rupees twenty five thousand) with two sureties of the like amount each
    to the satisfaction of learned Additional Sessions Judge-II, Latehar in
    connection with S.T. Case No. 272 of 2023 arising out of Chhipadohar P.S.
    Case No. 04 of 2019 with the condition that he will co-operate with the
    trial of the case and furnish his mobile number and photocopy of the
    Aadhar Card in the court below with an undertaking that he will not
    change his mobile number during the trial of the case and will not
    annoy or disturb the informant or witnesses of the case.
