The instant complaint is filed by complainant against
accused under Section 200 of Cr.P.C for the offence
punishable under Section 138 of N.I.Act and punish the
accused in accordance with law in the interest of justice
and equity.
2. The brief facts of the case of the complainant is that:
It is submitted that, the complainant is a
proprietorship concern. The complainant had supplied
electronic and its related items to the accused under
Invoice No.XIN/10869 dated 26.12.2020 for the tune of
Rs.6,83,148/- and promised to pay the said amount
forthwith. Further contended that towards payment of the
said amount, the accused had issued cheque bearing
Judgment 3 C.C.No.25520/2021
No.000560 dated 27.01.2021 for a sum of Rs.6,83,148/-
drawn on Oriental Bank of Commerce, Banashankari
Branch, Bengaluru in favour of complainant and assured
that the said cheque would be honoured on its
presentation.
