1. The petitioner seeks compliance of the judgment dated 31.08.2017 passed in
SWP No. 2916/2015 titled ‘Mohd. Iqbal vs. State of J&K and others‘.
2. There has been no representation on behalf of the petitioner on the last nine
consecutive dates of hearing. Today also, when the matter was taken up,
none appeared on behalf of the petitioner.
3. It appears that the judgment dated 31.08.2017 was assailed by the
respondents in LPA No. 37/2018 titled ‘State of J&K vs. Mohd. Iqbal‘, which
came to be dismissed vide judgment dated 03.05.2018. Thereafter, the
respondents preferred SLP(C) Diary No. 30263/2018 titled ‘State of J&K vs.
Mohd. Iqbal‘, which also came to be dismissed by the Hon’ble Supreme
Court vide order dated 12.08.2025.
4. Learned counsel for the respondents submits that the judgment has been
implemented by issuance of Government Order No. 293-JK(GAD) of 2026
dated 06.03.2026, whereby it has, inter alia, been directed that:

“(i) The retired official (petitioner) shall be entitled to payment of salary
and other service benefits to which he would have been entitled to, in the
absence of Government Order No. 877-GAD of 2015 dated 30.06.2015.
(ii) The release of consequential benefits shall depend upon the outcome
of the pending criminal trial/departmental proceedings/court case, if
any, against the petitioner.
(iii) The payment of salary in terms of the instant Government Order
shall be subject to the deduction of three months’ salary and allowances
paid to him at the time of premature retirement, in lieu of notices as
envisaged under Article 226(2) of J&K CSRs.
(iv) The retired official (petitioner) shall furnish an undertaking to the
effect that he was not gainfully employed anywhere during the period
w.e.f. 30.06.2015 (date of premature retirement) upto 28.02.2018 (date of
superannuation).”
5. A copy of the aforesaid Government Order is taken on record.
6. In view of the aforesaid, the judgment having been implemented, no further
proceedings survive in the present contempt petition. Accordingly, the
proceedings in the contempt petition are closed. The petitioner shall,
however, be at liberty to seek revival of the same, if cause survives.
