01. Petitioner, through the medium of this petition, seeks initiation of
contempt proceedings under Sections 10 and 12 of the Contempt of
Courts’ Act, 1971 against the respondent/contemnor for willful defiance
and non-compliance of the order dated 28.08.2023 passed in WP(C) No.
934/2023 titled -“Mohd. Din vs UT of J&K & Ors.“.
02. The respondent/contemnor has filed compliance/status report and has
also placed on record consideration order dated 24.10.2024, whereby in
compliance to the order, non-compliance of which is alleged in the
instant contempt petition, the matter has been considered and the claim
of the petitioner was found not merit worthy with regard to removing his
name from the list of OGWs maintained in the record of Police Station
2 CCP(S) No. 343/2024
In
WP(C) No. 934/2023
Basantgarh, as such, matter was rejected in the interest of security of the
UT of J&K.
03. This Court while disposing of WP(C) No. 934/2023 on 28.08.2023, had
been pleased to pass following direction:-
“Respondent No. 3-SSP Udhampur to consider the claim
of the petitioner by treating this writ petition as
representation and decide the same expeditiously,
preferably within a period of six weeks by passing a
speaking order with reasons.”
04. Upon consideration of the matter, it is observed that the order has been
substantially complied with by the respondent and in case, the petitioner
is further aggrieved, he shall be at liberty to challenge the order of
rejection passed by the Senior Superintendent of Police (SSP),
Udhampur in compliance to order dated 28.08.2023, passed in
WP(C) No. 934/2023.
05. The petition is, accordingly, disposed of, as settled.
