1. Supplementary affidavit filed today annexing the certified copy of the verification report, the same is taken on record.
2. Heard Sri Sunil Kumar Dwivedi, learned counsel for the applicant, Sri Mohammad Zakir, learned counsel for O.P. No.2 and Sri Rajiv Kumar Singh, learned AGA for the State and perused the record.
3. This application under Section 482 Cr.P.C. has been preferred with a prayer for quashing/set aside the entire proceedings including impugned charge sheet dated 14.10.2016 of Criminal Case No. 12407 of 2016 (State Versus Kasim and another) arising out of Case Crime No. 20 of 2016 under Sections 420, 120-B of I.P.C., Police Station Sikandarabad, District Bulandsahar pending before learned Chief Judicial Magistrate, Bulandshahar and further prays to stay the further proceedings in the aforesaid case during the pendency of present application.
4. Learned counsel for the applicants submits that dispute arises out of civil dispute between the applicant and the opposite party no. 2. The parties have reconciled their differences and a compromise has been entered between them, the same has been verified by the court below on 28.02.2026. Certified copy of the order dated 03.12.2025 is annexed along with supplementary affidavit filed today.
5. Learned Additional Government Advocate has submitted that since the parties have entered into compromise, which has also been verified by the concerned court, therefore, no useful purpose would be served if the proceedings of the aforesaid case go on further.
6. Learned counsel for the opposite party No. 2, is also present. He has no objection to the statement, made above.
7. In view of the above, it is deemed proper and meet the ends of justice that the proceeding of the aforementioned case be quashed.
8. The present 482 Cr.P.C. application stands allowed, keeping in view the compromise made by the applicant as well as opposite party no.2, the entire proceedings of Criminal Case No. 12407 of 2016 (State Versus Kasim and another) arising out of Case Crime No. 20 of 2016 under Sections 420, 120-B of I.P.C., Police Station Sikandarabad, District Bulandsahar pending before learned Chief Judicial Magistrate, Bulandshahar is hereby quashed.
