01. By the instant writ petition, the petitioners have
challenged Order dated 12.03.2026 passed by the Deputy
Commissioner, Shopian, whereby the application
preferred by the petitioners under Sections 22 and 23 of
the Maintenance and Welfare of Parents and Senior
Citizens Act, 2007, came to be rejected on the ground
that proceedings under the Protection of Women from
Domestic Violence Act, 2005, had already been initiated
by the respondents before the Court of the learned Chief
Judicial Magistrate, Shopian. It was further observed
that, by an interim order dated 07.08.2025 passed in the
said proceedings, the learned Chief Judicial Magistrate,
Shopian, had restrained the petitioners herein from
dispossessing respondent No. 5 from the shared
household situated at Malik Mohalla, Ada, Shopian.
