Josh Sterling, a Litigation & Arbitration partner at Milbank LLP and former Director of the CFTC’s Market Participants Division, joined a webinar discussion on Prediction Markers hosted by PolicyPartner on July 28, 2026.
Mr. Sterling discussed the CFTC’s proposed rulemakings for event contracts alongside the federal preemption fight playing out in multiple states, the doctrinal arguments driving a potential circuit split, and enforcement and intermediary obligations for participants across the ecosystem.
Mr. Sterling currently leads Milbank’s nationwide litigation efforts concerning the legality of event contracts and prediction markets and advises early-stage and established companies on developing novel financial products, including perpetual futures and security futures.
