[1] Heard Mr. HS Paonam, learned sr. counsel assisted by Ms. H.
Malemleima, learned counsel on behalf of the petitioner.
[2] The petitioner was appointed as Lower Division Clerk (LDC) in the
Office of the Directorate of Rural Development & Panchayati Raj, Govt. of
Manipur, vide order dated 31.12.2026 along with 73 (seventy-three) persons and
petitioner was no. 1 in the merit list. The learned sr. counsel for the petitioner
submits that the next promotion post for the post of LDC is Accountant and as
per Recruitment Rules, LDC having 5(five) years regular service and having
passed Office Procedures & Accounts Training conducted by the State
Government would be illegible for promotion to the post of Accountant. It is also
stated that petitioner is at sl. no. 33 in the combined seniority list published for
LDC in RD & PR department, Manipur and while issuing the impugned promotion
order dated 17.07.2026, she was not considered and her juniors in the sl. nos.
34, 35, 37 & 38 have been recommended, who are private respondent nos. 3 to
6 in the present writ petition. The learned sr. counsel for the petitioner refers to
the office memorandum dated 15.05.2014 where, the zone of consideration for
14 (fourteen) posts is five times the number of vacancies and petitioner ought
to be included in the zone of consideration as she is at sl. no. 33 and her juniors
be considered and appointed.
