    1. We have perused the submissions made by Mr. Shailesh Madiyal,

    learned senior counsel, who was appointed as amicus curiae and also

    2. Without prejudice to the rights and contentions of the parties

    Reason:

    submitted that perhaps it would be in the interest of justice as

    well as the parties, more specifically the petitioner herein, that

    the Report of the Probation Officer is called for with regard to

    the conduct of the petitioner under the provisions of the Probation

    of Offenders Act, 1958.

    3. The petitioner has already suffered incarceration for a period

    of 65 days. It is argued that after the occurrence of the

    incident; during trial; during the pendency of the appeal, and

    thereafter, the petitioner has maintained good conduct. Let

    Report of the Probation Officer be called for within a period of

    two weeks from today.

    4. We direct the Senior Superintendent of Police-respondent No.1

    herein, to ensure compliance of the order.
