[2026:RJ-JD:13946] (2 of 3) [CRLMB-11196/2024]
2. Learned counsel for the accused-petitioners submits that the
accused-petitioner have falsely been implicated in this case for the
offences under Section 8/15, 25 and 29 of NDPS Act. It is
contended that the recovery of contraband article was effected
from an abandoned vehicle and the petitioners name has been
mentioned by other co-accused Kamlesh @ Kama and Mithalal
who have been enlarged on bail by the Coordinate Bench of this
court vide orders dated 14.11.2025 and 24.09.2025 respectively.
The accused-petitioners are in judicial custody since long and the
trial of the case may take considerable time, therefore, the bail
application of the accused-petitioners may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail
application and submitted the FSL report which shows that the
article recovered from the petitioners was found to be
mephedrone and the quantity of mephedrone recovered from the
petitioners’ possession is below commercial quantity.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for
the petitioners and the fact that similarly placed co-accused have
been granted bail and looking to the fact that the accused-
petitioners are in custody since long and the trial of the case may
take considerable time, therefore, without commenting anything
on the merits of the case, I deem it just and proper to enlarge the
accused-petitioners on bail.
6. Accordingly, the bail applications under Section 483 BNSS is
allowed and it is ordered that the accused-petitioners Mangilal
S/o Binjaram and Bhanwar Singh S/o Sohan Singh, in
connection with FIR No. 100/2019 registered at Police Station
