Heard the parties.
The petitioner has moved this Court for grant of bail in
connection with Cyber Case No.22 of 2024 arising out of Cyber
Crime P.S. Case No. 140 of 2024 registered for the offences
punishable under sections 419/420/467/468/471/120B of the
Indian Penal Code and under Section 66B/66C/66D of the
Information Technology Act.
The learned counsel for the petitioner submits that this is the
second journey of the petitioner with the prayer for regular bail
and earlier the prayer for regular bail of the petitioner was rejected
by a Co-ordinate Bench of this Court vide order dated 11.02.2025 in
B.A. No. 10139 of 2024. It is next submitted by the learned counsel
for the petitioner that the fresh ground is that so far three
witnesses including the victim have been examined by the trial
court but none of them except the P.W.3 has taken the name of the
petitioner nor identified him and though the P.W.3 has taken the
name of the petitioner but he has not identified the petitioner and
in para-7 he has only stated that he came to know about the name
of the petitioner while coming to the trial court in connection with
this case. In para-10, he has categorically stated that he has not
seen the petitioner. It is further submitted that the allegations
against the petitioner are all false. It is next submitted that the
petitioner has been in custody since 01.07.2024, as has been
mentioned in paragraph no. 01 of the bail application. It is further
submitted that the petitioner undertakes to cooperate with the trial
of the case and further undertakes that he will not annoy or disturb
the informant or the witnesses of the case in any manner during
the trial of the case. Hence, it is submitted that the petitioner be
admitted to bail.
The learned Spl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as
discussed above, I am inclined to enlarge the above-named
petitioner on bail. Accordingly, the petitioner is directed to be
released on bail on furnishing bail bond of Rs.25,000/- (Rupees
Twenty Five Thousand) with two sureties of the like amount each
to the satisfaction of learned Additional Judicial Commissioner-II-
cum-Special Judge, Cyber Crime, Ranchi, in connection with Cyber
Case No.22 of 2024 arising out of Cyber Crime P.S. Case No. 140 of
2024 with the condition that the petitioner will co-operate with the
trial of the case and will furnish his mobile number and photocopy
of the Aadhar Card with an undertaking that he will not change
his mobile number during the trial of the case, with further
condition that he will not annoy or disturb the informant or the
witnesses of the case in any manner during the trial of the case.
