    Md. Abdul Baquee Khan, learned counsel appearing for the petitioners

    and Mr. S. Vijayanand Sharma, learned senior panel counsel appearing

    for the respondents.

    [2] At the outset, learned senior counsel appearing for the

    petitioner submitted that the petitioner has been hospitalized and

    undergoing medical treatment due to his illness. It has been further

    submitted that at present, the petitioner is at Intensive Care Unit (ICU)

    and his doctor has given advise for carrying out surgical operation of the

    petitioner. In that view of the matter, learned senior counsel submitted

    that the petitioner will not be in a position to run the canteen now and

    that the present writ petition can be closed by giving one week’s time to

    the dependents/family members of the petitioner to voluntarily vacate

    the said canteen in question.

    [3] Mr. S. Vijayanand Sharma, learned senior panel counsel

    appearing for the respondents fairly submitted that he has no objection

    in disposing of the present writ petition as proposed on behalf of the

    petitioner. However, the learned counsel submitted that a fix time frame

    be given by this Court for vacation of the said canteen voluntarily and in

    the event of failure to do so within the time frame, the authorities may

    be permitted to vacate the same unilaterally.

    [4] In view of the submission made above, the present writ

    petition is disposed of with the following directions :-

    (i) The petitioner or any of his dependent/family members
    are at liberty to voluntarily vacate the premises of the
    canteen in question within a period of one week from
    today.

    (ii) In the event, the dependent/family members of the
    petitioner failed to vacate the occupation of the canteen in
    question within the aforesaid period of one week, the
    respondents are at liberty to vacate the same unilaterally.

    [5] With the aforesaid directions, the present writ petition is

    disposed of.
