1. The petitioners seek transfer of proceedings
pending against it under Sections 138 and 141 of the
Negotiable Instruments Act, 1881 (“N.I. Act”).
2. A perusal of the complaint would reveal that the
collecting bank through which the cheque was
presented for collection is located within the
territorial jurisdiction of the Court where the
proceedings are pending. Therefore, in light of the
provisions of Section 142(2)(a) of the N.I. Act as
also the decision of this Court in M/s Shri Sendhur
Agro & Oil Industries v. Kotak Mahindra Bank Ltd. 1, a
case for transfer is not made out.
