Heard learned counsel for the petitioner and learned

APP for the State.

2. The petitioner seeks bail in connection with

Phulparas PS Case No. 189 of 2024 instituted for the offence

punishable under Sections 341, 323, 307, 504, 506, 379,

354B/34 of the IPC and Section 27 of the Arms Act pending in

the Court of learned Additional Chief Judicial Magistrate II,

Jhanjharpur, Madhubani.

3. The petitioner is alleged to have fired upon the

informant.

4. Learned counsel for the petitioner submits that

the FIR states that the bullet crossed closely by the head of the

informant. It is further submitted that the FIR was lodged on

18.05.2024 for the occurrence of 14.04.2024.

5. Learned A.P.P. for the State has vehemently

opposed the prayer for grant of bail to the petitioner.

6. Considering the unexplained delay in lodging the

FIR as well as the fact that the gunshot fired by the petitioner

does not result in any corresponding injury, this Court is

inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on

furnishing bail bonds of Rs.10,000/- (Ten thousand) with two

sureties of the like amount each to the satisfaction of Court

below/concerned Court in connection with Phulparas PS Case

No. 189 of 2024.
