Vide order dated 20th March, 2026, we had issued show
cause notice to Mr. Anand Singh Chauhan, Project Director, NHAI
under the Contempt of Courts Act. Pursuant thereto, Mr. Anand
Singh Chauhan, Project Director, NHAI, is present in person. Mr.
Sengupta, learned counsel for NHAI states that he has been
instructed to appear on behalf of Mr. Anand Singh Chauhan.
2. Mr. Sengupta states that he has filed an affidavit on behalf
of Mr. Anand Singh Chauhan pursuant to the show cause notice
issued by this Court under the Contempt of Courts Act against
Mr. Anand Singh Chauhan. We have perused the affidavit dated
8th April, 2026. Having perused the same we do not find that the

affidavit is happily drafted, as the affidavit is more in the nature
of justification, clarification and explanations offered by Mr.
Chauhan. When the same was pointed out to Mr. Sengupta,
learned counsel sought permission to withdraw the said affidavit
with liberty to file a fresh affidavit on behalf of Mr. Anand Singh
Chauhan.
3. Since Mr. Sengupta tenders his unconditional apology for
the manner in which the affidavit dated 8th April, 2026 has been
prepared and seeks leave to withdraw the said affidavit with
liberty to file a fresh affidavit on behalf of Mr. Anand Singh
Chauhan, we permit Mr. Sengupta to withdraw the said affidavit
dated 8th April, 2026 grant liberty to file a fresh affidavit. The said
affidavit to be filed latest by 14th April, 2026.
4. Stand over to 14th April, 2026.
