1. The petitioners (wife and son) filed an Application under

Section 125 of the Code of Criminal Procedure seeking maintenance

SPONSORED

being Criminal Case No.937/2018 titled “Smt. Kusam Lata & Anr. vs.

Sunder Singh” filed by the petitioners pending in the Court of the

Principal Judge, Family Court, Ghaziabad, Uttar Pradesh to the

Principal Judge, Family Court, Udham Singh Nagar at Uttrakhand.

2. The petitioner (wife) has also sought transfer of Complaint

Case No.3087/2018 filed under Sections 12, 18, 19, 20, 22, 23 of

the Protection of Women from Domestic Violence Act, 2005 titled

“Smt. Kusum Lata vs. Shri Sunder Singh and Ors.” pending in the

Court of ACJM(6), Ghaziabad, Uttar Pradesh to the ACJM, Udham Singh

Nagar at Uttrakhand.

3. Sufficient cause having been made out by the petitioners

4. Consequently, (i) Criminal Case No.937/2018 titled “Smt. Kusam

Lata & Anr. vs. Sunder Singh” pending in the Court of the Principal

Judge, Family Court, Ghaziabad, Uttar Pradesh is ordered to be

transferred to the Principal Judge, Family Court, Udham Singh Nagar

at Uttrakhand and (ii) Complaint Case No.3087/2018 under Sections

12, 18, 19, 20, 22, 23 of the Protection of Women from Domestic

Violence Act, 1989 titled “Smt. Kusum Lata vs. Shri Sunder Singh

and Ors.” pending in the Court of ACJM(6), Ghaziabad, Uttar Pradesh

is ordered to be transferred to the ACJM, Udham Singh Nagar at

Uttrakhand.

5. The entire record pertaining to the said cases shall be

transmitted forthwith by the transferor court to the transferee

court.

6. Pending applications, if any, also stand disposed of.
