    Heard learned counsel for the parties.

    2. The petitioner-husband and respondent no.3-wife

    SPONSORED

    are also physically present and identified by their

    respective counsel. Though, the present petition has

    been filed for quashing of FIR dated 16.06.2022,

    registered as Crime No. 118 of 2022 at Police Station

    Mahila Thana, Raipur, Chhattisgarh, filed by the

    respondent no.3-wife against the petitioner-husband,

    the Court had referred the parties to Supreme Court

    Mediation Centre. In the mediation, the matter has

    been settled between them. A joint application has

    3. The Settlement Agreement is reproduced as under:

    SETTLEMENT AGREEMENT

    This Settlement Agreement is entered into between
    Petitioner- Kulpreet Singh Kalda S/o Amrik Singh
    Kalda, R/o. 2-A Cycle Society, Rasta Peth, Pune –
    411011 (here in after referred to as Petitioner-
    Husband) and Rashi Saluja D/o Jagdeep Singh Saluja,
    R/o Raheja Residency, Flat No. A-801, Avanti Vihar,
    Raipur – 492004 (here in after referred to as
    Respondent-3 wife).

    1. Whereas the marriage between the petitioner and
    respondent wife was solemnized as per Hindu rites
    and ceremonies on 01.12.2021 at Raipur. After
    marriage parties resided together at Pune and there
    is no issue out of wedlock.

    2. Both the parties resided together as husband
    and wife till 08.03.2022, and thereafter disputes
    and differences arose between the parties and since
    then she is staying with her parents at Raipur. The
    Petitioner husband filed divorce having HMA No. 145
    of 2023 before the Additional Principal Judge Family
    Court at Raipur seeking dissolution of marriage.

    3. Whereas the Parties have filed following cases
    against each other:-

    (i) Petitioner husband has filed divorce having
    HMA No. 145 of 2023, Under Section 11 of Hindu
    Marriage Act, before the Additional Principal
    Judge Family Court at Raipur.

    (ii) Petitioner/Husband has filed RCC No.
    2960 of 2022, Under Section 378, 494, 420, 406,
    120 B of IPC, filed before 7th Joint Civil
    Judge J.D. and JMFC Pune.

    (iii) Respondent No.3/wife has lodged FIR No.
    118 of 2022 at Women Police Station, Raipur.

    (iv) Respondent No.3/wife MCC No. 356 of
    2022, under Section 125 Cr.P.C. before
    Principal Judge Family Court, Raipur.

    4. Whereas Hon’ble Supreme Court vide Order dated
    12.01.2026 in Special Leave Petition (Crl.) No.
    15174 of 2024 has referred the matter to Supreme
    Court Mediation Centre. Comprehensive mediation
    sessions were held between the parties and their
    respective advocates on 28.01.2026 (virtual) and
    today i.e. 06.02.2026 (physically for signing of the
    present Settlement Agreement).

    5. Both the parties hereto have arrived at an
    amicable settlement on the following terms and
    conditions for dissolution of marriage by mutual
    consent:-

    A. That the parties have agreed that the
    Petitioner-husband will pay to the Respondent-
    wife total sum of Rs. 22,00,000/- (Rupees
    Twenty Two Lakhs Only) towards full and final
    settlement of all her claims towards her
    permanent alimony, Stridhan, maintenance
    (past, present, future) and any other claim
    whatsoever.

    B. It is agreed between the parties that they
    will move an application jointly before the
    Hon’ble Supreme Court under Article 142 of
    Constitution of India for invoking inherent
    powers of the Hon’ble Supreme Court praying
    for divorce by mutual consent as parties are
    staying separately since 09.03.2022 i.e. for
    the last more than three years and there is
    irretrievable break down of the marriage.
    C. It is further agreed between the parties
    that if Hon’ble Supreme Court is pleased to
    allow application filed by both the parties
    under Article 142 of Constitution of India
    then the petitioner husband shall withdraw
    divorce petition and the respondent wife shall
    withdraw the cases filed by her. The
    Petitioner –husband will pay to the Respondent
    Wife a total sum of Rs. 22,00,000/- (Rupees
    Twenty Two Lakhs Only) via DD in the name of
    Rashi Saluja. The DD would be handed over to

    the Respondent No. 3 – Wife – Rashi Saluja on
    07.04.2026 in the Court where the matter is
    listed.

    6. That the Petitioner and the Respondent have
    agreed that none of them will initiate any other
    legal action or complaint against each other or
    against the family members of each other in respect
    of their matrimonial dispute in future.

    7. That subject to the aforesaid terms, the
    parties have resolved all the disputes amicably in
    relation to the marriage and have been left with no
    claims against each other or their respective family
    members.

    8. That by signing this Agreement the parties
    hereto solemnly state and affirm that they have no
    further claims or demands against each other
    including maintenance, or any movable or immovable
    property and all the disputes and differences have
    been amicably settled by the parties hereto through
    the process of mediation.

    9. The parties undertake to abide by the terms and
    conditions set out in the above mentioned Settlement
    Agreement, which have been arrived with free will of
    the parties without any coercion, duress or
    collusion and parties undertake not to raise any
    dispute whatsoever henceforth.

    10. The contents of this settlement – agreement
    have been explained to all the parties through their
    respective counsels and they have understood the

    4. From the same it transpires that the parties have

    sought for quashing of pending proceedings, details

    of which have been given at Paragraph No.3 of the

    Settlement Agreement. It has further been prayed that

    the Court may exercise its jurisdiction under Article

    142 of the Constitution of India and grant a decree

    of divorce by mutual consent to the petitioner-

    husband and respondent no.3-wife. As per the

    Settlement Agreement, petitioner-husband is required

    to pay an amount of Rs.22,00,000/- (Rupees Twenty Two

    Lakhs) through a demand draft in the name of the

    respondent no.3-wife. Today, the said demand draft

    bearing no. 963367, dated 07.05.2026 drawn on HDFC

    Bank, Raipur, has been handed over by learned counsel

    for the petitioner-husband to the respondent no.3-

    wife.

    5. We have also interacted with the parties and are

    satisfied that the terms of the Settlement Agreement

    are as per their own free will.

    6. Accordingly, the cases mentioned at Paragraph

    No.3 of the Settlement Agreement are quashed.

    7. Further, in exercise of the power of this Court

    under Article 142 of the Constitution of India, we

    dissolve the marriage between the petitioner and

    respondent no.3 by granting a decree of divorce by

    mutual consent. I.A. No.102667 of 2026 stands allowed

    accordingly.

    8. Registry to issue decree of divorce accordingly.

    9. The Special Leave Petition stands disposed of in

    the aforementioned terms along with pending

    application(s), if any.
