    1. The present Appeal has been filed against the impugned

    judgment and decree dated 24.09.2012 passed by the Fifth

    Additional District Judge, Bilaspur, District Bilaspur (C.G.) in Civil

    Suit No.05-A/2011 whereby the suit preferred by the appellant has

    been dismissed.

    2. It is submitted that the parties to the present appeal are sisters

    and brothers, and the dispute giving rise to the present

    proceedings has been amicably settled through a family

    settlement between them. Pursuant to the said settlement, the

    parties have arrived at a mutual compromise and in view of the

    aforesaid family settlement and compromise, the appellant does

    not wish to prosecute the present appeal any further.

    3. On going through the terms and conditions of the compromise

    arrived at between the parties, this Court is satisfied that the same

    has been entered into voluntarily, out of free will and without any

    coercion or undue influence. The parties, being brothers and

    sisters, have amicably resolved their dispute through a family

    settlement, which appears to be just, fair and lawful. The

    compromise does not appear to be contrary to law or public

    policy.

    4. The parties to the first appeal have filed a compromise

    dead/docket duly signed, which was further verified and parties

    have unequivocally confirmed the compromise deed/docket

    stating that they have settled their dispute outside the Court.

    5. Accordingly, the compromise is hereby accepted and taken on

    record, and the first appeal stands disposed of in terms of the

    compromise arrived at between the parties outside the Court.
