1. This set of Intra-court appeals are directed against the
judgment and order dated 10.08.2016 passed in Special Civil
Application No. 10365 of 1995.
2. At the outset, from the array of parties in the writ
petition, we may note that the writ petition was filed by the
heirs of Parshottam Kashibhai Patel, with the statement,
“heirs of the joint family of deceased Parshottam Kashibhai
Patel”. Out of five petitioners, two petitioner Nos. 1 and 2,
namely, Jayantibhai Ramdasbhai Patel and Ratilal Jasingbhai
Patel are stated to be nephew of deceased Parshottam
Kashibhai Patel. Petitioner Nos. 3, 4 and 5 are stated to be
brothers of deceased Parshottam Kashibhai Patel. All have
