1. Heard Shri Prince Kumar Srivastava, learned counsel for the applicant, Shri Ran Vijay Singh, learned counsel for opposite party no. 2 and learned A.G.A for the State and perused the material on record.
2. This application under Section 528 Bhartita Nagrik Suraksha Sanhita, 2023, (in short BNSS), has been filed by the applicant to quash entire proceeding of Criminal Case No. 85188 of 2024 (State Vs. Ishwar Chand), arising out of Case Crime No.267 of 2022, under Sections 417, 420, 406, 504, 506, 467, 468 and 471 Indian Penal Code (in short I.P.C.), Police Station Lalpur/ Pandeypur, District Varanasi, including the charge-sheet No. 01 of 2023 dated 02.10.2023 as well as cognizance/ summoning order dated 11.09.2023, pending in the Court of Civil Judge (Senior Division)/ F.T.C. Varanasi.
