2. Heard Ms. Neha Rathi, learned counsel appearing for
the petitioner and Ms. Apoorva Anand, learned counsel
appearing, on advance notice, for the respondent-State.
3. Learned counsel for the petitioner drawing
attention to the affidavit filed by the Investigating
Officer before the Trial Court (page 212 pdf 245) submits
that as Accused No.6, she only had notarized the
documents. No doubt, learned counsel submits that she had
status as a notary seized in 2018. However, according to
her, she had applied for renewal and was under the
impression that as long as she had applied, she could
continue to notarize the documents.
4. Further drawing attention to page 169 (pdf 202)
which is the bail order of Accused No.3, she submits that
it was Accused No.7-Moinbhai Diwan who according to the
prosecution had forged the Aadhaar Cards in the name of
the complainant-co-owners. Learned counsel submits that
the petitioner had no role in the forgery and taking the
prosecution case at the highest is at best a case of the
violation of the Notary Act.
5. Issue notice on the application for condonation of
delay as well as on the Special Leave Petition.
6. Let a counter affidavit/status report be filed by
the respondent-State dealing with the above aspects.

7. List the matter on 24th July, 2026.
8. In the meantime, in the event of arrest, the
petitioner shall be enlarged on anticipatory bail to the
satisfaction of the Investigating Officer in connection
with FIR No.11209017230683 dated 25th August, 2023
registered at Police Station Himatnagar Station Rural,
District Sabarkantha, Gujarat for offences under Sections
406, 420, 465, 467, 468, 471 and 120-B of the Indian
Penal Code, 1860.
9. The petitioner shall, however, extend full
cooperation with the investigation.
