1. It appears that conviction under Section 138 Negotiable Instruments
Act of the petitioner was upheld by the appellate court and in the present
revision, the predecessor bench suspended the sentence, subject to the
petitioner depositing the balance fine amount of Rs.1,68,000/- with the
Registry of this Court. That amount was deposited. During pendency of this
revision, the respondent no. 2 passed away leaving behind his widow and
three children.
2. The matter was listed today on a working Saturday so that it would be
disposed of. Lawyers are on strike but learned counsel for respondent no. 2
has appeared. But petitioner who appears in person has not appeared. There
is no reason for petitioner having not appeared today. Matter has to be
adjourned. Petitioner shall pay cost of Rs.15,000/- by way of demand draft
in the name of widow of respondent no. 2 on the next date.

3. At the same time, the legal representatives of respondent no. 2 may
file an application for release of the amount already deposited by the
