ORDER (ORAL)
[1] Heard Mr. Stephen P., learned counsel appearing for
the petitioner, Mr. Shyam Sharma, learned GA appearing for the
respondents No. 1 & 2 and Mr. Amarjit, learned counsel representing

Mr. S. Kaminikumar, learned CGC appearing on behalf of respondent
No. 3.
[2] The present writ petition pertains to claim of
compensation by the writ petitioner for the land acquired by the
Government. According to the petitioner even though his land has
been acquired, no compensation has been given by the authority for
acquisition of his land. The learned counsel also submitted that
during the pendency of this writ petition, the petitioner has
approached the Deputy Commissioner/CALA, Kangpokpi District,
Manipur (respondent No. 2) by submitting a representation dated
Nil.04.2026 which was received by the office of the Deputy
Commissioner/CALA, Kangpokpi District on 02.05.2026 and that the
said representation is still pending for consideration and disposal by
the respondent No. 2.
[3] It has been submitted by the learned counsel
appearing for the petitioner that the petitioner will be satisfied if the
present writ petition is disposed of by directing the respondent No.
2 to consider the said representation submitted by the petitioner on
its own merit and strictly in terms of the applicable Acts and Rules
and to dispose of the same by issuing a speaking order within a
stipulated period.

learned counsel appearing for the respondents fairly submitted that
as the prayer made on behalf of the petitioner is confined to the
consideration and disposal of the representation submitted by him,
they have no objection in disposing of this writ petition as prayed
for by the learned counsel appearing for the petitioner.
[5] Considering the submission advanced by the learned
counsel appearing for the parties and on perusal of the records, this
Court is satisfied that the interest of justice will be served by issuing
the following directions:-
(1) The respondent No. 2, viz., the Deputy
Commissioner/CALA, Kangpokpi District,
Manipur is hereby directed to consider the
representation submitted by the petitioner on its
own merit and strictly in terms of the provisions
of section 3H(4) of the National Highways Act,
1956 and to pass appropriate orders.
(2) The whole process should be completed within a
period of 3 months from the date of receive of a
certified copy of this order.

(3) The respondent No. 2 is further directed to
communicate to the petitioner as well as to the
respondent No. 3 about any decision taken by
him in connection with the said representation
within a period of 3 weeks from the date of
taking such a decision.
[6] With the aforesaid directions, the present writ petition
is disposed of.
