1. These three writ petitions were relating to deployment and

engagement of vocational trainers in Government Schools of

Rajasthan, through vocational training providers (VTP) and

implementation of vocationalization of secondary and higher

secondary education and vocational training of out of school

children in Rajasthan. All three writ petitions were heard on

different occasions and now by a common order, we are

disposing of these writ petitions.

2. CWP No.12054/2025 Govindram and Ors. Vs. State of

Rajasthan and Ors. is lead matter and for ready reference,

we are reproducing the prayer:

I. Quash and set aside the letters dated 13-06-
2025 to service providers, whereby, informed
that agreement entered between provider and
council is cancelled due to not service appointed
vocational trainer till 20-03-2025 and adopted
malafide practices in appointment of vocational
trainers.

II. Quash and set aside the letters dated 16-
18/06/2025, issued by Additional District
Coordinators whereby, agreement entered
between service provider and council is
cancelled due to not appointed vocational trainer

till 20-03-2025 and adopted malafide in of
vocational practices appointment trainers as
mentioned in letters dated 13-06-2025.

III. The action-omission on the part of
respondents in engaging the petitioners and
taking the work through placement
agency/service providers may be declared
arbitrary and accordingly the respondents may
be directed to directly engage the petitioners on
contractual basis, without any involvement of
any placement agency/contractor, and they may
be allowed to continue till the regular selections
are being made by the respondents, in the
interest of justice.

IV. The respondents may kindly be directed to
allow the petitioners to continue to work as
Vocational Teachers/Trainers at their respective
posting palaces, where they are working
presently, in the interest of Justice.
V. By an appropriate writ, order and directions
respondents be directed to release the salary of
petitioners from march 2025 to June 2025.

3. Brief facts of the case are that the petitioners are working as

vocational subject trainers under the scheme for the last

several years through vocational training providers (VTPs),

and now the respondents have cancelled the engagement

agreement with VTPs as the VTPs have failed to engage and

appoint vocational trainers as per requirements of the

respondents. The petitioners, who are working as vocational

trainers through different agencies, have filed this petition to

protect their rights and livelihood.

4. Learned counsel for the petitioners, while referring guidelines

for enrolling quality contractual vocational trainers in

schools, has submitted that the respondents are duty-bound

to engage vocational trainers directly and not through any

VTPs (human service provider agency). He further submitted

that as per National Education Policy (NEP) 2020, it is

necessary to engage vocational trainers, and the guidelines

as referred by the respondents clearly provides for

engagement of vocational trainers through VTPs or directly,

but in order to benefit the VTPs, the engagements have been

made through VTPs. He further submitted that VTPs are

even not being paid salaries on monthly or regular basis to

the petitioners, and VTPs have adopted unfair labour

practices in dealing vocational trainers.

5. Learned counsel has further submitted that many times this

issue has been raised before this Hon’ble Court, where

employees were engaged through intermediary agencies,

and due to exploitation in implementation by the

intermediary agencies, the individuals have faced problems

of exploitation and issue of non-payment and ultimately

payment of their wages. He also submitted that it is settled

law that one set of contractual employee cannot be replaced

with another set of a contractual employee.

6. Learned counsel has further referred judgment in case of

Manish Gupta and others vs. President Jan Bhagidari

Samiti reported in 2022, 15 SCC 540, and submitted that

an ad-hoc employee cannot be replaced by another ad-hoc

employee, and he is entitled to continue till replaced by a

regularly selected candidate. He further referred judgment in

case of State of Rajasthan vs. Kusum Devi, DB SAW No.

1231/2017 decided on 20.03.2018, passed by a Division

Bench of this Hon’ble Court, and submitted that after

considering other judgments, the Hon’ble Division Bench has

passed an order that a contractual employee, either by

contract or through placement agency, would not be

replaced by another set of contractual employee. He also

submitted that in case of Chairman Army Public School

and another versus Anamika Saxena reported in 2021

(1) RLW 227 (RA), a Division Bench of this Hon’ble Court

has considered judgment in case of Mohammad Abdul

Kadir and Anr. vs DGP, Assam reported in 2009 (6)

SCC 611, and submitted that the practice of Army Public

School to engage teachers on contractual basis and dispense

their service at any time of the term was not considered

good, and a direction is made that one set of contractual

employee cannot be replaced by another.

and Ors. vs Union of India and others (SB CWP

No.18481/2024), Captain Shailendra Pal Singh vs

State of MP (SCP No.23509/2024), Satya Prakash

Shahvs vs State of MP (2024: MPHC-JBP:43938), and

submitted that it is settled position of law that a contractual

employee cannot be replaced with another set of contractual

employee whether he is engaged directly or indirectly. He

further submitted that in case of Rattanlal vs State of

Haryana (1984 (4) SCC 43), Hon’ble Supreme Court has

held that there should not be any artificial break during the

course of service, which is sufficient to show that the

respondents cannot force the petitioners at every change of

service provider (VTPs) to enter into a new agreement.

8. Learned counsel for petitioners further submitted that the

practice adopted by the respondent is contrary to the policy

decision of the Government of India. Learned counsel for

petitioners have further submitted that in the neighbouring

state of Haryana and other states as well, this scheme is

implemented, but all vocational trainers are engaged directly

or not indirectly through any VTP. He further submitted that

engagement of service providers, agency, and permitting

exploitation is contrary to not only scheme but also against

the purpose of the scheme. He further submitted that state

is considered as model employer, and as a model employer,

the state has to set certain parameters, and these

parameters should be ideal. He further submitted that they

are neither challenging the terms of the scheme nor norms

as prescribed by Union of India, so Union of India is not

required to be arrayed as a necessary party. He further

submitted that scheme is implemented by respondents,

hence respondents are duty bound to implement the scheme

for the welfare of the people of the State of Rajasthan, as

the scheme is for advancement of education to the illiterate

masses who require education. At last, he submitted that

petitioners have approached this Hon’ble Court to protect

their rights and interest as it is affecting their livelihood.

9. Aforesaid contentions were opposed by learned AAG and

learned counsel appearing on behalf of respondents. Learned

AAG and learned counsel have submitted that the entire

educational program is a centrally sponsored scheme funded

and administered by Ministry of Education, Government of

India, but Union of India is not added as a party, therefore,

these writ petitions are not maintainable. He placed reliance

upon judgment in case of Mumbai International Airport

(P) Limited Vs. Regency Convention Centre and Hotels

(P) Ltd., reported in (2010) 7 SCC 417, and State of

Assam versus Union of India reported in 2010 10 SCC

408.

10. Learned AAG and learned counsel have also submitted that

petitioners have no locus to file writ petition against the

respondents, as there is no privity of contract between

petitioners and the respondents. He further submitted that

petitioners are neither engaged nor employed by the

respondents, and the employer of the petitioners are not

arrayed as party in the writ petitions, therefore, petitioners

have no right to file writ petitions and enforce their rights

against the respondents. He further placed reliance upon

judgment in case of Binny Ltd. versus Sadashivan

reported in 2005 6 SCC 657, and Joshi Technologies

International Inc. versus Union of India, reported in

(2015) 7 SCC 728. He also submitted that the respondents

have terminated the contract of service providers VTPs, and

after the termination of contract, petitioners have filed this

writ petition to force proxy litigation upon the respondents,

and same is not permissible under the law.

11. Learned AAG has also submitted that it is the discretion of

the respondents, as per clause 11.17.5 of policy dated

12.10.2022, to directly engage trainers or through VTPs. He

further submitted that the petitioners have not challenged

the policy; therefore, they cannot seek any direction against

the respondents to engage them directly when they are

working through service providers. He further referred

judgment in case of Delhi Science Forum Vs. Union of

India, reported in 1996 2 SCC 405, and Ugar Sugar

Workd Ltd. versus Delhi Administration reported in

(2001) 3 SCC 365, and submitted that normally the court,

in their power of judicial review, do not interfere with the

policy decision of the executive unless it is established that

there is unreasonableness and arbitrariness on part of the

respondents. He further submitted that the engagement was

contractual and co-terminous with contractors through

agreement; therefore, the petitioners have no right to file

the writ petitions against the respondents, and they cannot

seek any relief against the respondents.

12. Learned AAG has referred the provisions of RTTP Act and

rules made therein and submitted that the respondents have

followed a transparent and fair procedure as prescribed to

engage contractual, and judicial review in tender matters is

highly impermissible. He further submitted that the

petitioners have no right to block tender or deployment of

new VTPs. He further submitted that the petitioners can

enforce their right against the VTP, but not against the

respondents, and if the petitioners are engaged by VTPs,

then the liability to make payment of salary is upon VTPs

and not on respondents. He further submitted that the court

cannot direct for creation of posts or restructuring of

schemes in light of judgment in case of PU Joshi Vs.

Accountant General reported in (2003) 2 SCC 632. At

last, he submitted that the petitioners, if aggrieved from

terms of the scheme or implementation of scheme, may file

PIL to challenge the terms of the scheme.

13. Heard learned counsel for the parties and learned AAG.

Perused the material placed on record, also considered the

judgments as referred by learned counsel for the parties

during the course of argument.

14. The first objection of learned AAG is that petitioners have not

made Union of India as party respondent, and for this

purpose, he placed reliance upon judgment in case of

Mumbai International Airport (P) Limited Vs. Regency

Convention Centre and Hotels (P) Ltd. (supra), and

State of Assam versus Union of India (supra). The

second objection is that petitioners have no locus to file the

writ petition, as they were not engaged by the respondents,

rather they were engaged by VTP’s (contractor).

15. Learned AAG has placed reliance upon judgment in case of

Binny Ltd. versus Sadashivan (supra), and Joshi

Technologies International Inc. versus Union of India

(supra). A perusal of writ petitions clearly indicate that

petitioners have specifically mentioned that the respondents

are implementing a centrally sponsored scheme of Union of

India, in particular Human Resource Department (now

Education Department). The petitioners have placed reliance

upon terms of the scheme, and they have not challenged

any term or condition of the scheme. The petitioners have

only raised issue regarding engagement of petitioners

through VTPs and selection of VTPs by the respondents. It is

very clear from the material on record that neither the

scheme nor the terms of scheme were challenged by the

petitioners. The petitioners have not sought any relief

against Union of India. The issue raised herein is regarding

implementation of Scheme in accordance with guidelines of

Govt. of India.

16. A necessary party is indispensable, meaning thereby, in the

absence of such party, the Court cannot pass a mechanical

and foreseeable order, as the right and interest of such party

are directly and vitally affected from the order passed by the

Court. A proper party is not essential to the core of relief,

but adds a complete result to all involved issues. The

impleadment of such party facilitates a comprehensive

adjudication of the dispute.

17. In case of Udit Narain Singh Malpaharia vs Additional

Member, Board Of Revenue, Bihar reported in AIR

1963 SC 786, and Prabodh Verma v. State of Uttar

Pradesh, reported in (1984) 4 SCC 251, the emphasis

was on complete adjudication of dispute and impleadment of

parties directly interested in the matter. In case of Poonam

vs State of UP reported in (2016) 2 SCC 779, non-

joinder of necessary party was considered vital to the case.

In said case, a termination order was challenged, wherein it

was held that it is not necessary to implead a person

appointed in place of terminated person, as subsequent

appointee is not a necessary party.

18. In case of Mumbai International Airport (P) Limited Vs.

Regency Convention Centre and Hotels (P) Ltd.

(supra), Hon’ble Supreme Court has considered the issue of

necessary party and held that if necessary party is not

impleaded, the suit itself is liable to be dismissed. A proper

party is a party who, though not a necessary party, is

present, whose presence would enable the Court to

completely, effectively, and adequately adjudicate upon all

matters in dispute.

19. In case of State of Assam vs Union of India (supra),

placing reliance upon judgment in case of Udit Narain

Singh Malpaharia vs Additional Member, Board Of

Revenue, Bihar (supra), it was held that in absence of

necessary party, no order can be made effectively, and in

absence of proper party, an effective order cannot be made,

but presence is necessary for complete and final

adjudication.

20. Having considered the legal position with regard to the

necessary and proper party, when we consider the case of

petitioners, then it is apparent that the petitioners have not

raised any dispute about terms of the scheme and they have

not sought any relief against Union of India. Neither of the

conditions of the scheme or guideline about the

implementation were challenged by the petitioners;

therefore, the Union of India is neither a necessary party nor

a proper party. The objection raised by learned AAG is not

tenable.

21. The material on record or facts as placed on record clearly

indicate that the petitioners were engaged through VTPs

(service provider or contractors), but they are discharging

services with respondents under a scheme. The scheme as

placed on record indicates that in the National Education

Policy 2020 (NEP-2020), the Government of India has

focused upon vocational education to the students by giving

them vocational exposures at earliest ages at the stage of

middle and secondary school, with stress upon quality

vocational education. The policy document realized a fact

that vocational education is perceived to be unfair to

mainstream education and meant largely for students who

are unable to get with later. This is the perception that

affects choices of the students make. Setting a target for

2025, it was mentioned that at least 50% of learners from

the school and higher education systems shall have exposure

to vocational education, for which a scheme, action plan for

targets and timelines will be developed. This is in alignment

with sustainable development goal (SDG) 4.4 and will help

to realize full potential India demographic dividend, and

vocational education will be integrated into all schools and

higher education institutions in a phase manner over the

next decades.

22. Pursuant to the recommendations of NEP 2020, Samagra

Shiksha Scheme was redesigned and realigned. A letter

dated 12.10.2022 by the Ministry of Education, Department

of School Education and Literacy, Government of India, was

sent with updated version of framework for implementation

of Samagra Shiksha Scheme to deliver quality education to

pre-primary to secondary schools.

23. The focus of the Union of India is upon providing quality

vocational education in all schools at early stages so as to

overcome the social stigma. The scheme document suggests

that scheme will be implemented in the schools by the

State/UTs Government through the respective Department of

School Education or Board of Secondary Education. At the

State level, School Education Board, SCERT, State

Government schools and Government aided schools are key

stakeholders, whereas District Institute of Education and

Training (DIET) is at district level. Thus, the respondents are

only implementing agencies, and they are being guided by

the policy document as prepared by the Government of

India. We are also confining ourselves to the policy of the

Government of India, and we are not going beyond policy as

prepared by the Government of India.

24. Before referring the implementation part, we are referring to

letter dated 24.03.2017 issued by Ministry of Human

Resource Development, Department of School Education and

Literacy, about guidelines for enlisting quality educational

vocational trainers in the school. These guidelines were

issued after a meeting held on 10.03.2016. These guidelines

are required to be considered while engaging vocational

teachers/trainers. These guidelines suggest engagement of

vocational trainers, selection procedure, and capacity

building of vocational trainers. The stress is on selection of

good and competent vocational trainers having domain

specific knowledge of the relevant subject. The guideline

permits direct engagement or appointment through VTPs,

but in case of appointment through VTPs, selection may be

tender based and the procedure by a committee having

representative of both the State Government and VTPs.

25. The guidelines also suggest that VTPs should have been

accredited at NQAF Grade-II or higher. In neighbouring

State, Haryana, initially vocational trainers were engaged

through VTPs, but later, taking a lead in development and

acting as a model employer, the Government of Haryana has

decided to continue their service directly and further

enhance their monthly honorarium. The engagement

document clearly indicates that Haryana Kaushal Rozgar

Nigam Limited (HKRNL) is involved in the procedure, and

engagement has been made through HKRNL and further

benefits were also provided to these vocational trainers.

26. The respondents have placed reliance upon condition number

11.17 of point 5 of the policy document. Clause 11.17 of

policy document, along with letter dated 12.10.2022, relates

to faculty and staff, and 11.17.5 provides for recruitment of

vocational teachers/trainers. Before this, 11.17.3 provides

for engagement, and we are referring to 11.17.3 and

11.17.5 in following paragraphs:

“11.17.3 Teachers are critical factors for
bringing about necessary qualitative changes in
VET. Quality research and dissemination to
increase understanding of pedagogical, technical
and managerial aspects of flexible learning is
neaded. Vocational courses will be conducted
with the help of Teachers/Skill Trainers as well
as guest faculty on a need basis. Teachers/Skill
Trainers with such qualifications and experience
as laid down by the PSSCIVE for each cluster of
vocational courses may be engaged. State and
UTs have the flexibility to engage the Vocation
Trainers directly or through the vocational
Training providers (VTPS) accredited by NCVET
The States will have to ensure that teachers,
trainers are selected well in advance before the
commencement of the academic session.

States/UTs may consider engaging with
Vocational Training Providers (VTPs) Vocational
trainers for a minimum period of two years
through the appropriate Memorandum of
Understanding (Molj), after following the due
procedure.

11.17.5 The Vocational Teachers/Trainers may

be recruited through the VTPs but they report to
the school for the complete academic year, just
like all other teachers. The VTs are not just
involved in organising learning experiences in
the school, but also providing necessary support
in developing linkages with the industry and
organising activities outside the school. The
Teachers/Skill Trainers will impart knowledge of
both the theory and practical. The performance
appraisal of Teachers/Skill trainers shall be
conducted at the end of each academic session
and their further retention shall be linked to the
delivery of quality output.”

27. Aforesaid 11.17.3 indicates that teachers and skilled

trainers, as well as guest faculty, can be engaged on need

basis. The qualification and experience as laid down by

PSSCIVE for each cluster of vocational courses has to be

taken care of. The State and UT were given flexibility to

engage vocational trainers directly or through VTPs

(accredited by NCVET). The State has to ensure that

teachers/trainers are selected well in advance from the

commencement of the academic session. The engagement of

vocational trainers or VTPs are required for minimum period

of two years through appropriate MOU after following the

procedure.

28. The facts narrated hereinabove clearly indicate the

respondents have discreation either to engage vocational

trainers/teachers through a VTP or directly. It is not

mandatory for the respondents to engage any vocational

trainer/teacher through a service provider (VTP). The service

provider is not required to be engaged by the respondents.

The respondents are not under any obligation to follow the

RTTP Act or rules made therein in direct engagement of any

of the vocational trainer/teacher to implement the policy as

laid down by Government of India.

29. In case of Manish Gupta and others vs. President Jan

Bhagidari Samiti (supra), Hon’ble Supreme Court has laid

down that one set of contractual employee cannot be

replaced by another set, and this judgment has been

followed by a Division Bench of this Court in case of State of

Rajasthan vs Ram Chaturvedi while deciding engagement

of guest faculty in Vidya Sambhal scheme.

30. Similarly, in case of Mohammad Abdul Kadir and Anr. vs

DGP, Assam (supra) and Rattanlal vs State of Haryana

(supra), Hon’ble Supreme Court has laid down that there

should not be artificial break of service of such contractual

employees. The Division Bench of this Court in case of State

of Rajasthan vs Kusum Devi (supra), has clearly laid

down that one set of contractual employee cannot be

replaced by another set of employee.

31. In case of Tony Meghwal (supra), Radha Rani (supra),

Pankaj Kumar (supra), Seema Gupta (supra), Atul

Kumar (supra), Anil Kumar (supra), Deepti Pandey

(supra), and many more judgments, this Court has laid

down that a set of contractual employee, whether engaged

directly or indirectly, if serving and engaged by the State or

instrumentality of State, then their services should not be

replaced by another set of contractual employee unless the

service is replaced by a regularly selected candidate.

32. In case of Army Public School vs Anamika Saxena,

(supra), a Division Bench of this Court has considered case

of a teacher whose services were discontinued after every

year and a fresh engagement process is initiated, but

deprecating the practice, it was held that one set of

contractual employee cannot be replaced by another. Same

analogy is adopted by other High Courts such as Madhya

Pradesh and Delhi, as referred and relied by learned counsel

for the petitioners. If a person is engaged in a contractual

manner and he is serving, then his services cannot be

replaced with another set of contractual employee. If a

service provider is changed and the manpower remains the

same, then it is sufficient to draw a conclusion that the

agreement is sham or nominal. If any person is engaged

through a contractor, then he has no right to bind the

principal employer, but when he acts under control and

supervision of the principal employer, then the Court has to

consider the relationship between the principal employer and

the employee. The principal employer is always responsible

for payment to the workforce engaged directly or indirectly.

33. Here, in this case, the scheme of engaging vocational

trainer/teacher provides a discretion to the respondents to

engage vocational trainer/teacher on contractual basis,

indirect or direct manner. We agree with the proposition as

advanced by the learned AAG that the Court should not

interfere in the policy decision in implementing the scheme.

34. In case of Binny Ltd. versus Sadashivan (supra), and

Joshi Technologies International Inc. versus Union of

India (supra), the issue relates to private contract and not

involving any State instrumentality. The facts in case of

Binny Ltd. versus Sadashivan (supra) and Joshi

Technologies International Inc. versus Union of India

(supra), are different than present one; therefore, both the

judgments are not applicable upon the facts of instant case.

35. The petitioners are serving under the Government scheme,

and the scheme is subject to guidelines issued by the Union

of India. The petitioners are engaged to implement the

scheme have acquired a right as soon as they were engaged,

therefore, petitioners have right to challenge the decision of

the respondents when their services are terminated with the

termination of contract of the VTPs.

36. The petitioners have a rightful claim to maintain a writ

petition for interference in their rights to continue, which

have been acquired while serving in Government scheme till

the scheme is continued and have right to resist when same

set of contractual employees are replaced by another set of

contractual employees through another contractor (VTPs).

37. The legal position as mentioned herein above clearly

indicates that one set of contractual employee cannot be

replaced with another set of contractual employee. In case

when a contractual employee is engaged through a service

provider, then after every year engaging another service

provider will increase the risk of exploitation of workforce,

and threat to discontinue their services. A new contractor

(VTP) may discontinue the services of petitioners. A

contractor may engage a human resource upon his terms

and conditions of engagement. In such circumstances, no

law permits discontinuing of employee after end of every

year. Such discretion is an abuse of authority by the

respondents. Thus, the petitioners are before this Court to

seek remedy to enforce and protect the right of their

livelihood.

38. The change of service provider VTPs, either following RTTP or

rules at the end of every year, will increase the risk of

exploitation of the petitioners. Thus, a petitioner has a right

to approach this Court while invoking constitutional remedy

under Article 226 of the Constitution of India, and that is

only remedy provided under the law to enforce the legal and

constitutional rights of the petitioners.

39. Lack of job security and also non-compliance of social

security norms are very much prevalent in workforce

engagement through a service provider. There is always a

risk of exploitation, reduction in wages, and untimely

payment. This Court, while considering identical issue in

cases of Tony Meghwal (supra) and Radha Rani

(supra), has highlighted this fact and directed for direct

engagement. The continuity of a contractual employee can

only be maintained when a workforce is directly engaged.

Similarly, the principle of non-replacement of contractual

employees by another set of contractual employees can only

be implemented if the engagement is made directly.

40. These petitioners have a right to approach this Court, and

this is not a challenge to the policy, rather it is a challenge to

mode of engagement. Learned AAG has also objected that

by the current litigation, on the ground that the petitioners

are protecting the interest of VTPs and it is a proxy litigation

on behalf of VTPs. The engagement may be direct or

indirect, but engagement policy has to be consistent. A

neighbouring State, Haryana is an example, where the

persons engaged through VTPs were continued, and engaged

directly. Now, they were paid directly by the State

Government. This clearly indicate that policy in question can

be implemented by direct engagement of individuals. The

engagement is always subject to condition of scheme. If the

scheme is discontinued by the Government of India,

obviously the engagement (may wither direct or indirect) will

also be discontinued by the Govt. of India. The respondents

are under no obligation to continue the services when the

scheme is discontinued by the Govt. of India. Similarly, the

selection process is stringent, though nothing is placed on

record by the respondents to show that the petitioners were

selected through a process as referred herein above. It

means that only a contractor was selected as per norms of

the tender and everything is left upon whims of the

contractor (VTPs). The implementation of the scheme is not

in accordance with the object of the scheme. This litigation

may not be treated as a process of stalling tender process.

The respondents may engage trainers directly as per norms

and continue their services till scheme is in force.

41. The State of Haryana has chosen a State-controlled

organization HKRNL, therefore the State of Rajasthan can

also adopt the same. It will not only be beneficial to the

petitioners, but it will also help in effective implementation of

NEP 2020. Thus, the objections raised by learned AAG have

no force. The petitioners were engaged through VTPs, but

termination of contract of VTPs has resulted into termination

of services of petitioners, as it is co-terminous with principal

contractor. The tender document dated 07.08.2024 and

annexures indicate that the estimated cost of engagement is

₹130.06 crores, meaning thereby substantial amount has

been allocated under the scheme for engagement of

vocational trainers, but the selection process does not

indicate that the guidelines as mentioned herein above were

followed at the time of selection of vocational

trainers/teachers, in State of Rajasthan.

42. It is apparent on record that respondents have not followed

the guidelines and terms of the scheme, and now they are

claiming that they are free to implement the scheme in their

own way. When respondents are implementing the scheme,

as part of NEP 2020, a standardized procedure is required to

be adopted, but same is not part of the reply submitted by

the respondents.

43. The engagement process and the arguments advanced

before the Court clearly indicate that respondents are casual

in implementing the scheme and they are not serious in

implementation of scheme. The policy document issued by

the Government of India is required to be followed in letter

and spirit, and at least minimum standards prescribed by the

Government of India are required to be taken care of. If the

respondents are not able to upscale the engagement

process, then at least they must follow practice adopted by

the neighbouring State. In the instant case, it is not

necessary for the respondents to engage through VTPs and

issue a tender for selection of VTP, to engage vocational

trainers. The services of the petitioners cannot be replaced

by another set of employee, whether engaged directly or

indirectly.

44. One of the issue, which we have already considered is that

the petitioners have no right to claim regularization on any

count, as their engagement is contractual in nature. If the

scheme is withdrawn or closed by the Government of India,

the services cannot be continued by the State Government

unless the State decides to continue the scheme, and same

is a policy decision wherein Court cannot direct for

continuing the scheme. If the scheme is withdrawn, though

this is not a case as on today, but till scheme is continued,

petitioners have right to restrain respondents from replacing

their services through another set of contractual employees.

45. In case contract between service provider (VTP) and the

respondents has been terminated, then the option left before

the respondents is to engage of petitioners directly through

a contract. The respondents may evolve a procedure either

engaging themselves or through a Government Corporation,

established for skill development in the State. The policy

decision, in this regard can be taken by the State

Government. This Court is not inclined to intervene in the

matter of contract between VTPs and respondents but at the

same time, if does not intervene to protect the livelihood of

petitioners then with the termination of contract of VTPs, the

services of petitioners will come to an end, and as a result,

the services will be replaced with another set of contractual

employees engaged through another VTPs, selected through

a tender process. This situation is sufficient to invoke

jurisdiction under Article 226 of the Constitution of India.

46. Considering aforesaid, this is necessary to balance the

equities, therefore, the respondents are at liberty to examine

each case of the petitioners, in particular about their

qualification, and may adopt a process of examining the

qualifications of the petitioners whether they are having the

qualifications as prescribed under the guidelines, before

entering into a direct engagement. If anyone is not

possessing the requisite qualification, the respondents are

free to terminate his services and not required to carry on a

non-qualified person, but if somebody is qualified, then he

should not be permitted to be exploited by any contractor or

service provider. The respondents are duty bound to show

and project themselves as a model employer. Thus, the

circumstances of the case clearly indicate that it is an ideal

case where the Court should balance the equities and

intervene to protect the rights of the petitioners.

47. In view of the discussion made herein above, these petitions

are allowed in the following manner:

(i). The respondents are directed to engage petitioners,

vocational trainers/teachers, directly on contractual basis as

per guideline dated 12.10.2022. The respondents are

refrained from engaging petitioners through any VTPs.

(ii). The termination of services of petitioners, who were

engaged through service provider (VTPs), after termination

of agreement with VTPs, is hereby quashed and set aside,

and respondents are directed to engage petitioners subject

to scrutiny of their qualifications as prescribed in the

guidelines, directly in a contractual capacity.

(iii). The respondents are directed to pay the honorarium

directly to the petitioners through bank transfer mechanism.

(iv). The engagement of petitioners shall be subject to terms

and conditions of the scheme, and they will terminate as

soon as the scheme is closed or changed by the Government

of India.

(v). The services of petitioners shall not be replaced with

another set of contractual employees till force of the

scheme.

(vi). The respondents are directed to frame specific

guidelines/rules for governance of these petitioners, if the

engagement contract provides so.

(vii). The respondents are free to get engagement through a

skill development corporation of the State of Rajasthan.

48. Accordingly, the writ petitions along with miscellaneous

applications, if any, stand disposed of.
