Mr. S.S. Yadav, learned counsel for the
applicants.
2. Mr. Himanshu Sain, learned AGA, for the State
of Uttarakhand/1 and 2.
3. Mr. Aditya Singh, learned counsel for the
respondent no.3.
4. Primarily the dispute appears to be matrimonial
one. Applicant no.1 married with the respondent no.3
and there are no issues from this marriage, but due to
some matrimonial discord in between both of them,
they are living separately since 2025.
5. Now the instant petition is moved by the
applicants under Section 528 of BNSS, 2023
challenging the proceedings of Criminal Case No.3062
of 2026, “State of Uttarakhand Vs. Gaurav Pathak and
others“, pending in the court of learned Chief Judicial
Magistrate, Haridwar, wherein, both the applicants
have been summoned to face the trial for the offences
punishable under Sections 498-A, 323, 427, 504 and 506
of IPC and under Sections ¾ of the Dowry Prohibition
Act, 1961, arising out of Case Crime No.555 of 2025,
dated 29.09.2025, at P.S. Kotwali Jwalapur, District
Haridwar.
6. On the previous date, learned counsel for the
applicants was directed to get the instructions whether
the applicants are ready for amicable settlement and
today Mr. S.S. Yadav, learned counsel, on instructions
apprised to this Court that the applicants are ready to
settle the dispute with respondent no.3, however, he
submits that some reasonable time may be given to
them to appear before this Court since they are
residing in Gujarat.
7. Mr. Aditya Singh, learned counsel, on
instructions, also submits that respondent/wife is also
ready for an amicable settlement.
8. In such view of the matter, list this matter on
14.08.2026.
9. On that day, both the parties may join the
proceedings.
10. Till the next date of listing, and taking into
consideration that the efforts are being made for
amicable settlement, further proceedings of Criminal
Case No.3062 of 2026, “State of Uttarakhand Vs.
Gaurav Pathak and others“, pending in the court of
learned Chief Judicial Magistrate, Haridwar, shall
remain stayed.
