    Act, 1988.

    4. We have heard learned counsel appearing for

the appellant as well as the respondent – State of

    Uttar Pradesh.

    5. Having regard to ground on which the

application for anticipatory bail came to be

dismissed by the High Court, we are of the

considered opinion that interest of justice would be

sufficiently served if the prayer for release on pre-

arrest bail is granted subject to terms and conditions

    mentioned hereafter.

    6. Appellant is admitted to an order for grant of

bail in anticipation of arrest subject to the condition

that he shall appear before the trial court on each

and every date fixed, either physically or through

bail on terms and conditions to be imposed by the

trial court and subject to such other terms and

conditions as may be imposed by it for grant of pre-

    arrest bail.

    8. In the result, the impugned judgment and order

    stand set aside.

    9. Needless to observe, the appellant shall not,

directly or indirectly, by making inducement, threat

or promise, dissuade any person acquainted with

the facts of the case from disclosing such facts to

any police officer or to the court.

    10. We clarify that the observations made in this

order and grant of bail to the appellant in

anticipation of arrest will not be treated as findings

on the merits of the case.

    aforesaid terms.
